Whether a county can be sued depends on sovereign immunity and its exceptions, including the waiver conditions that apply to counties. A crash with a county or city truck follows different steps than a crash with a private driver, and the deadlines can be much shorter.

The biggest difference is the written notice. Georgia law requires a written claim to go to the government body before a lawsuit can move forward. Lawyers call this ante litem notice, which means a notice filed before a suit.

For a city, the claim must be presented within six months. For a county, it must be presented within 12 months after the claim accrues or becomes payable.

Missing that window can end a claim before it starts. The crash date is where the clock begins, so write that date down first. Outcomes depend on the facts of each case, and this page explains the general framework.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Government Trucks Are Treated Differently Under Georgia Law

Lawyers call this sovereign immunity, a legal shield for government bodies. A person hurt by a government vehicle can’t simply file suit the way they would against a private company.

Georgia’s respondeat-superior statute makes a person answerable for torts a servant commits while doing that person’s business, but a county or city’s sovereign immunity still applies, so that statute alone does not establish government liability. Georgia’s statute on liability for the torts of others states that a person is liable for torts committed by his wife, his child, or his servant, either at his command or in the prosecution and within the scope of his business, whether those torts are committed by negligence or voluntarily. A county or city driver on government work raises that same question of who answers for the crash.

That is why the government body is the first party you deal with. The notice goes to the governing authority, not only to the driver. Knowing who must receive the notice helps you avoid a delay that could cost you the claim.

Every government claim is different. The driver’s job, the route, and the vehicle’s role in the crash all shape the next steps.

The Ante Litem Notice Deadline: Six Months for Cities, Twelve for Counties

For a city, the written claim must be presented within six months of the event. The city rule is in O.C.G.A. Title 36 text. The claim must state the time, place, and extent of the injury, and the negligence that caused it.

After the claim is presented, the city must consider and act on it within 30 days. That action, unless it settles the claim, does not block a later lawsuit.

For a county, the rule is shorter to state but just as strict. All claims against a county must be presented within 12 months after they accrue or become payable, or they are barred. Minors and people under a disability get 12 months after the disability ends. The county rule appears in the same O.C.G.A. Title 36 text.

The city clock starts with the event itself, not the day you learned how serious your injury was. Don’t assume a later start date. Put both possible deadlines on your calendar right away.

What the Notice Must Include and How to Send It

A city notice must be in writing and presented to the city’s governing authority. It must also be served on the mayor or the chairperson of the city council or commission. Under Georgia law on claims against municipal corporations, a claim against a municipal corporation must be served on the mayor or the chairperson of the city council or city commission by delivering it personally or by certified mail or statutory overnight delivery.

The notice must state a specific dollar amount of damages you are seeking. That amount is an offer of compromise. If the claim is not settled and you go to court, you are not bound to that number.

Include the facts you know. List the date, time, and location of the crash. Note the vehicle’s unit number and department markings, the driver’s name if known, and each injury and expense.

Keep proof of delivery, such as a certified mail receipt, tracking record, and a copy of the notice. Each required item matters, so a missing detail can put the claim at risk.

How the Two-Year Lawsuit Deadline Still Applies

Georgia’s general rule is two years to sue for injuries to the person, measured from when the right of action accrues. That rule is in O.C.G.A. Title 9 text. Claims for loss of consortium have four years.

The notice and the lawsuit clocks work together. Courts cannot hear the case until the claim has first been presented to the governing authority. So the short notice date comes first in practice.

Georgia law also pauses the limitation period while a demand for payment is pending before a city without action by the city. That pause applies only while the demand sits without action. It is not a reason to wait.

If a family member died, a wrongful death case has its own timing and filing questions. Families should look at those early, while records and witnesses are still easy to find.

Who Can Be Named: The Government Entity, the Driver, or Both

The right defendant depends on who was driving and for whom. A government truck crash can involve the county or city, the driver, another vehicle, or a contractor doing the work.

Georgia divides fault among everyone who contributed to the harm.

Each liable person pays only its own share. Those damages are not joint liability, so one defendant is not made to pay for another’s share. Your own fault also matters. Your award is reduced by your share of fault (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). If you are 50 percent or more responsible, you cannot recover damages.

This is why a second driver’s role can change the value of a claim. Those facts need to be gathered early, while the crash details are still clear.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Damages and Limits That Can Apply to Government Defendants

Georgia separates general damages from special damages. General damages, such as pain and suffering, are presumed from a wrongful act and need no proof of an exact amount. Under Georgia law on damages, special damages are those which actually flow from a tortious act, and they must be proved in order to be recovered.

Necessary expenses from an injury are a legitimate part of the damages estimate. Keep every medical bill, receipt, and prescription record. Small injuries can produce only nominal damages, so the proof you gather matters.

In a wrongful death case, a surviving spouse, or children if there is no spouse, may recover the full value of the decedent’s life, as the evidence shows. Georgia wrongful death law provides that the surviving spouse shall receive no less than one-third of such recovery as such spouse’s share.

When death results from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses.

Costs of Filing and How the Fee Works

Court costs are set by the court where the case is filed. The first consultation with T. Madden & Associates, P.C. is free, confidential, and carries no obligation to continue.

T. Madden & Associates works on a no-fee-unless-we-win basis. That means no fee is owed unless the firm wins. You may still be responsible for court costs and case expenses.

Costs can matter in a government claim. Notice, investigation, and possible court filings each carry expenses. Ask how those costs are handled before you decide anything.

Raising cost questions early helps you plan. A clear answer now is better than a surprise later.

Steps to Protect a Claim After a Government Truck Crash

Start with medical care. Get checked, follow the treatment plan, and keep every bill and receipt. Those expenses are part of the damages estimate under Georgia law.

Get the crash report. Write down the government vehicle’s unit number, department markings, and the driver’s name if you have it. Note the time and the road conditions.

Take photos of the scene, the vehicle damage, and your visible injuries. Collect names and phone numbers of witnesses while they are still nearby.

Write a timeline while memory is fresh. Be careful about giving a recorded statement to any insurer before you get advice.

Calendar the six-month city date or the 12-month county date, measured from the event. Keep proof of every notice you send.

Talk With T.
