Cameron v. Jmp Pizza, Inc (2026)). This page explains how the truck accident injury deadline in Georgia works, which exceptions can change it, and which dates to write down now. It is general information, not legal advice for your case.

The Short Answer: When Georgia’s Two-Year Filing Period Begins

Under O.C.G.A. § 9-3-33, actions for injuries to the person must generally be brought within two years after the right of action accrues, though a loss of consortium claim has four years. That sets the general period for most personal injury claims, including those from a truck crash.

The statute ties the two years to when the right of action accrues, not to when symptoms appear.

Later symptoms are a common source of confusion. Pain, stiffness or headaches that appear days later do not appear in the statute as a separate start date.

The same two-year rule covers injuries to the person in a truck crash as it does in other motor vehicle collisions. Trucks add more parties and more records, but the general deadline stays the same.

If you are reading this while in pain, juggling bills and insurance calls, the rules can feel like a lot. Start with the crash date. Everything else builds from there.

For the broader picture on truck crash claims in Georgia, see our truck accident lawyer guide.

If your injuries showed up after a truck crash, the dates can feel overwhelming. Then they notice pain days or weeks later. That delay is common, and it is one reason the timeline feels unclear.

The date of an injury and the date you notice it are different dates. The statute looks to when the right of action accrues. Your first diagnosis can come much later, and that gap can confuse you and your family.

Write down symptoms the day you notice them. Note when they started, when you first told a doctor, and each medical visit after that. Use plain words, such as “neck stiff, couldn’t turn head Tuesday.” Keep the list in your phone or a notebook, and bring it to each visit.

Keep a simple list of missed work and the reason for each absence. Those dates help show how the injury affected your daily life. Dates in writing are easier to explain later than dates pieced together from memory.

When an Injury Is Hidden: Timing Arguments in Georgia

Sometimes an injury stays hidden for a while, and nobody can tell right away what caused it.

Courts look at the specific facts, not one rule for every truck crash. Do not assume a later start date. Treat the crash date as the starting point until someone reviews your facts.

It is not something you can assume will apply to your claim. Many people only learn the full picture after several tests, and the timing of those tests becomes part of the record.

Your records matter here. Medical notes, dated symptom logs and insurer letters show what you knew and when. Keep them together in one folder.

Exceptions That Can Change the Timeline

Some people and situations have different timing rules. These include minors, some people with disabilities, crimes that lead to prosecution, death claims, and claims against government bodies. Each exception has limits, so check the facts before relying on one.

Minors. A person under 18 when a claim accrues gets the same time after turning 18 as other people get to sue. O.C.G.A. § 9-3-90 says this, except where another section of the code provides otherwise.

Incapacity. Under the same statute, a person who is legally incompetent because of intellectual disability or mental illness when the cause of action accrues gets the same time after the disability is removed.

Criminal cases. If the crash led to a criminal case, O.C.G.A. § 9-3-99 tolls the victim’s tort claim from the date of the commission of the alleged crime until the prosecution has become final or otherwise terminated. That pause cannot go past six years, unless another section applies.

Death. When death results from a crime or from criminal or other negligence, O.C.G.A. § 51-4-5 lets the personal representative recover funeral, medical and other necessary expenses. A death claim has its own timing questions, and the facts drive them.

City claims. Claims against a city need a written claim to the governing authority within six months of the event. O.C.G.A. § 36-33-5 sets that six-month rule.

State claims. Claims against the state need written notice within 12 months of when the loss was or should have been discovered. O.C.G.A. § 50-21-26 sets that rule.

Vehicle damage. Damage to your vehicle is a separate claim.

Why Waiting to Find Out Can Put Your Claim at Risk

Waiting can cost you evidence, even when the filing deadline is still ahead. Scene photos, witness names and damage to the truck all change or disappear over time.

Trucking companies keep records, but only for set periods. 49 C.F.R. § 395.8 requires a motor carrier to keep records of duty status and supporting documents for at least six months from receipt.

49 C.F.R. § 379.3 says records may be destroyed after the minimum retention periods, at each company’s discretion.

Six months is much shorter than two years. Waiting for symptoms to fully develop can leave you with fewer records to show the injury and its link to the crash.

Evidence also includes your own notes, photos and the names of people who saw the crash. Each one is easier to find early.

The decision in front of you is whether to act on your timeline now. Waiting until the injury settles may be too late for some evidence.

What to Be Careful About When Speaking With an Insurance Company

Be accurate, keep answers short, and avoid guessing when an insurer calls. Insurers often call early, and an early call is not a deadline for your full story.

An adjuster may ask for a recorded statement or early medical details. You can say you need time to review your notes before answering.

Do not guess about speed, distance or how hurt you are. Say what you know, and say when you do not know yet.

Fault also matters. Georgia reduces damages by the injured person’s percentage of fault. O.C.G.A. § 51-12-33 says a plaintiff who is 50 percent or more at fault recovers nothing.

A fault dispute with the truck driver can change how the claim is valued.
