The phrase “new rule of hit and run” usually points to recently passed laws in other states and countries. For Georgia, the question is what a driver must do at the scene, how the charge can change, and what an injured person can do when the other driver leaves. This page answers those questions under Georgia law.<\/p>\n

What People Mean by the ‘New Rule’ for Hit-and-Run<\/h2>\n

Most results for this question describe newer laws outside Georgia. New Jersey named a hit-and-run law after a man killed in 2016, to help track down drivers who flee.<\/p>\n

What Georgia Law Requires of a Driver After a Crash<\/h2>\n

If you were the one hit, write down what you can right away. Note the other car’s color, make, plate number, and the direction it went. Short notes made at the scene are often the first details investigators get.<\/p>\n

Will a First Hit-and-Run Lead to Jail?<\/h2>\n

A first offense does not settle the question on its own. The facts of the crash shape the charge.<\/p>\n

Two people charged with similar acts can still see different outcomes, so no single case predicts another. Charging decisions and court timelines also vary from case to case.<\/p>\n

A criminal case can also affect a victim’s civil claim. Under O.C.G.A. \u00a7 9-3-99<\/a>, the running of the limitation period for a tort claim by the victim of an alleged crime is tolled from the date of the alleged crime or the act giving rise to the claim until the prosecution has become final or otherwise terminated, provided that such time does not exceed six years, except as otherwise provided in Code Section 9-3-33.1<\/a>.<\/p>\n

How Hit-and-Run Drivers Are Identified<\/h2>\n

Investigators usually start at the scene and with people who saw the crash. Witness accounts can narrow down the vehicle quickly.<\/p>\n

Physical evidence matters too. Damage left on the struck vehicle, such as broken lights, paint transfer, or a torn mirror, can point to the type of car. Debris at the scene and any nearby video can help as well.<\/p>\n

Evidence can fade with traffic and weather. That is why early notes matter. The new laws in New Jersey and elsewhere target this same problem: finding a driver who leaves. For someone hurt in a crash, the most useful step is writing down what you remember before the details fade.<\/p>\n

If the Other Driver Fled and You Were Hurt<\/h2>\n

If the other driver fled, your own auto insurance may be the first place to look for payment. Under O.C.G.A. \u00a7 33-7-11<\/a>, that coverage pays damages for bodily injury from an uninsured vehicle’s owner or operator, within limits the insured chooses. O.C.G.A. \u00a7 33-7-11<\/a> reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured\u2019s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.” The policy wording sets the details.<\/p>\n

Keep records from day one. Save photos, medical visits, witness names, and the police report number.<\/p>\n

Can I sue if the driver fled?<\/summary>

Georgia law allows an injured person to recover for breach of a legal duty that causes damage (O.C.G.A. \u00a7 51-1-6<\/a>).<\/p><\/details>

How long do I have to file?<\/summary>

For most injury claims to the person, Georgia generally gives two years after the right of action accrues<\/a>, one year for injuries to reputation, and four years for loss of consortium (O.C.G.A. \u00a7 9-3-33<\/a>).<\/p><\/details>

Does my own fault matter?<\/summary>

Yes. Damages are reduced by your share of fault<\/a>, and a plaintiff 50 percent or more responsible recovers nothing (O.C.G.A. \u00a7 51-12-33<\/a>).<\/p><\/details>\n
