This page answers the main ones in plain language.

The Short Answer: Who Is Usually at Fault When a Truck Changes Lanes

The driver who moved into an occupied lane without a safe gap is usually the first person whose conduct is examined. That is often the truck driver, but it is not automatic. Georgia looks at each crash on its own facts.

Investigators ask who moved, whether the gap was safe, and what each driver could see. They look at turn signals, speed, and where both vehicles were before contact. Whether a truck driver caused a crash depends on what happened in that crash, not simply on the truck having been involved.

A crash can also involve more than one at-fault party. When that happens, Georgia’s shared-fault rules decide how each person’s share affects what can be recovered.

If a truck moved into your lane and you are still sorting out who is responsible, our team is ready to talk with you about what comes next. A driver who skips those checks has a hard time explaining the crash.

Commercial trucks also follow federal rules. Under 49 C.F.R. § 392.2, every commercial motor vehicle must be operated under the laws of the place where it is driven. If a regulation of the Federal Motor Carrier Safety Administration imposes a higher standard of care than the state or local law, that Federal Motor Carrier Safety Administration regulation must also be followed.

Timing matters as much as the lane itself. A move made while another vehicle is alongside, or closing fast from behind, is exactly the kind of move these checks exist to prevent.

For an overview of truck claims in Georgia, read our truck accident guide.

How Georgia Divides Fault When Both Drivers Share Blame

Georgia reduces your recovery by your percentage of fault (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). It bars recovery if you are 50 percent or more responsible. Under O.C.G.A. § 51-12-33, the jury sets your share of fault, and the judge reduces the award in proportion to it. This is often called modified comparative fault, or shared fault with a limit.

Here is a simple, hypothetical example. Suppose a jury values your damages at $100,000 and assigns you 20 percent of the fault. The award would drop by $20,000, leaving $80,000. If you were found 50 percent or more responsible, the statute says you could receive no damages at all (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)).

Other people can share the blame too. The same statute says the fact-finder must consider everyone who contributed to the injury. That includes people who were never named in the lawsuit. Each liable person pays only that person’s own share, not a joint share, so the split matters for who pays what.

Why Truck Lane-Change Crashes Are Investigated Differently

Truck crashes can leave more records than car crashes, and those records can answer the lane-change question. Large trucks have big blind spots along the sides and rear. A driver may not see a car alongside the trailer at all. A long, loaded truck also needs more room to merge and takes longer to speed up or slow down.

Federal rules add another layer. Under 49 C.F.R. § 395.26, an electronic logging device (ELD) automatically records the date, time, location, engine hours, vehicle miles, driver and vehicle identification, and motor carrier identification data. That data can show where the truck was around the time of the crash.

Federal rules also limit phone use. 49 C.F.R. § 392.82 says no driver may use a hand-held mobile telephone while driving a commercial motor vehicle. A narrow exception permits hand-held use when necessary to communicate with law enforcement officials or other emergency services.

Alcohol testing follows its own timing. Under 49 C.F.R. § 382.303, an employer must test surviving drivers for alcohol as soon as practicable after certain crashes, but only when the accident involved loss of human life or the driver received a citation within 8 hours in the circumstances the rule lists. Those include crashes with an injury that needs treatment away from the scene, or a vehicle that must be towed away. If the test is not given within two hours, the employer must keep a record of the reasons.

Evidence That Shows Who Moved Into Whose Lane

The strongest evidence shows where each vehicle was before and after contact. Collect it early, because video can be overwritten and memories fade. Useful evidence includes:

Dash camera or traffic camera footage. If it exists, ask for it before it is overwritten.

The police crash report. It includes the diagram, the officer’s notes, and any citations.

Witness statements. Statements taken soon after the crash capture details while they are fresh.

Damage patterns. Side contact on one vehicle and front or rear damage on the other can show the angle of the move.

Photos. Lane markings, debris, and where each vehicle came to rest all help.

Truck electronic data. ELD records, described above, can show what the truck was doing before the crash.

When distraction is part of the question, phone records can matter. Our guide on proving a truck driver was on the phone explains that process.

When the Trucking Company Can Be Responsible Too

A trucking company can be responsible for a driver’s negligence when the driver was working for it. Under O.C.G.A. § 51-2-2, a person is liable for torts committed by a servant by the person’s command or in the prosecution and within the scope of the person’s business. That rule applies whether the harm came from negligence or was done voluntarily.

Claims may also look at how the company hired, trained, supervised, and maintained the truck. Those questions depend on the facts of the case.

Insurance is the other piece. Commercial truck policies can differ from personal auto policies. Georgia also limits when a motor carrier’s insurer can be named in the same lawsuit. Under O.C.G.A. § 40-1-112, joinder is allowed only in specific cases.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Arguments Drivers and Insurers Raise After a Lane-Change Crash

Insurers often argue that the injured driver came out of nowhere or sat in a blind spot. Those claims are tested against the position of both vehicles, not just one driver’s account.

Can you go 10 mph over the speed limit in Georgia?

Driving above the posted limit can be raised as a question about fault. Speed is one fact among many. Investigators weigh it alongside signals, positions, and sight lines.

How common is it to get sued after a car accident?

A claim can start with the insurance companies. If it is not resolved that way, it can proceed as a lawsuit in court. The process moves through the courts from that point.

A sudden swerve or a car “cutting in” is another common account. Test that account against the damage pattern, any footage, and the ELD timing. A story that does not match those facts deserves a close look.

Deadlines, Insurance Questions, and Steps to Take Now

Georgia generally allows two years to file a lawsuit for injuries to the person (O.C.G.A. § 9-3-33). Under O.C.G.A. § 9-3-33, those actions must be brought within two years after the right of action accrues. Loss of consortium claims have four years under the same statute. Some claims follow different rules, so do not assume the two-year period fits every case.

Will insurance pay if you leave the scene?

Your own uninsured motorist coverage may apply when the other driver or owner is unknown. Under O.C.G.A. § 33-7-11, the accident must be reported as the statute requires before a claim under that endorsement can proceed. When the other driver is unknown, a suit can name a “John Doe” defendant, and if the owner or operator’s identity becomes known, the action can be brought against that person in place of the “John Doe” defendant.

Will police do anything about a hit and run?

Police can take a report, and that report helps document the crash. Share every detail you have about the other vehicle, including its color, its direction, and any partial plate.

Practical steps help protect your claim. Get medical care and keep every record. Keep photos and the crash report. Be careful with recorded statements to the other side’s insurer until you have reviewed your position. Track towing and storage costs too. Our towing and storage guide explains how those costs are handled.

Talk With T.
