If there is no surviving spouse, a child or children can file.

Under O.C.G.A. § 51-4-2, the surviving spouse, or if there is no surviving spouse, a child or children, may recover for the homicide of the spouse or parent. The recovery is the full value of the life of the decedent, as shown by the evidence.

The claim centers on the death and the loss it causes the family. That is why the evidence about the person’s life, work, and family matters as much as the crash or event itself.

Sometimes no one qualifies under those sections. In that case, the administrator or executor of the estate may bring the action for the next of kin. The statute says the amount recovered is the full value of the life of the decedent. See O.C.G.A. § 51-4-5.

A child’s death follows its own rule. The rule comes from O.C.G.A. § 9-3-33.

The same statute sets different periods for other kinds of claims. For example, it sets a shorter period for injury to reputation and a longer period for certain loss of consortium claims. So each claim should be checked against its own timeline.

Waiting can cost a family its right to sue. That is why the date matters from the first day. Families should write down the date of death and the date of the injury right away.

Evidence also fades. Vehicle data can be overwritten. Video can be erased. Cars are often repaired or sold. Early investigation helps keep what still exists.

Notice rules can be shorter than the filing deadline. If a city may be involved, check that first.

How Fault Works: The 50% Bar Under O.C.G.A. § 51-12-33

Georgia cuts a claim by the share of fault assigned to the injured person. At 50 percent or more, no damages are recoverable. O.C.G.A. § 51-12-33 addresses how damages are reduced in proportion to the plaintiff’s percentage of fault, and how the trier of fact apportions damages among the persons who are liable according to each person’s percentage of fault.

Under subsection (a), the judge reduces the damages by the plaintiff’s percentage of fault (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). Under subsection (g), a plaintiff who is 50 percent or more responsible for the injury or damages claimed cannot receive any damages.

Under subsection (b), each liable person pays only its own apportioned share. Those shares are not joint. Under subsection (c), the fault of everyone who contributed is considered, even people who were never named in the suit.

Insurers and defendants often argue that the person’s own conduct played a part. They may point to speed, lane position, or safety equipment. How that argument applies to a death claim depends on the facts.

Helmets are a common example. Georgia law says no one may ride a motorcycle unless wearing protective headgear that meets state standards. See O.C.G.A. § 40-6-315. The Insurance Institute for Highway Safety publishes research on motorcycle crash deaths and helmet use by state and year.

Fault is a question of proof. Families should keep the facts organized from the start, including the crash report, photos, and witness names.

Common Wrongful Death Accidents Handled by Our Team

A wrongful death case begins with how the death happened. Each type of event raises its own questions about who is responsible.

Car crashes often turn on driver conduct, speed, and right-of-way. Our car accident lawyer page covers those claims in more detail.

Truck crashes often involve more than one company, such as a carrier, a driver, or a broker. That can mean more records to request. Our truck accident lawyer page explains that process.

Motorcycle and e-bike crashes raise questions about helmets, lane use, and road conditions. See our motorcycle accident lawyer and e-bike accident lawyer pages.

Slip and fall deaths usually turn on what the property owner knew and did about a hazard. Our slip and fall lawyer page covers that area.

Medical malpractice deaths turn on medical records, timing, and the care given. See our medical malpractice lawyer page.

Nursing home deaths may involve rights violations. Georgia law gives a person aggrieved by a long-term care facility’s failure to provide a right a cause of action for damages. See O.C.G.A. § 31-8-126 and our nursing home abuse lawyer page.

Negligent security deaths involve a third person’s wrongful conduct on a premises. A security contractor that assumes and undertakes a duty to invitees and licensees to keep all or part of a premises safe from the wrongful conduct of a third person may be liable only in the same manner, to the same extent, and subject to the same limitations as an owner or occupier, under O.C.G.A. § 51-3-57. Our negligent security lawyer page explains more.

Some families first face a serious injury that later becomes fatal. Our catastrophic injury lawyer page covers those cases.

Proving Negligence and Liability in a Georgia Wrongful Death Case

The family must show that someone’s negligence caused the death. Georgia allows recovery for breach of a legal duty that causes damage, as stated in O.C.G.A. § 51-1-6.

There must be a duty owed. That duty must be broken. The broken duty must cause the death.

Proof comes from records. The death certificate, medical examiner or coroner report, and hospital records show how and when the person died. The police or incident report, witness statements, and photographs show what happened at the scene.

Modern vehicles and equipment can hold useful data. Black box and dashcam records can show speed and braking. Maintenance and training records can show whether a company kept up its duties.

Brain injuries are a common cause of death after a crash or fall. The Brain Trauma Foundation provides general information on traumatic brain injury, including fatality and disability.

Causes of death are often disputed. Insurers may argue that a preexisting condition, not the event, caused the death. Reconstruction professionals and medical reviewers test those claims against timing, records, and physical evidence.

What Damages Can Be Recovered and Who Receives Them

Georgia measures a wrongful death recovery by the full value of the decedent’s life, as the evidence shows. That language is in O.C.G.A. § 51-4-2, which lets the surviving spouse or, if there is no surviving spouse, a child or children recover the full value of the decedent’s life, as shown by the evidence.

General damages law also applies. Damages compensate for injury where the injury can be estimated in money. If an injury is small or the mitigating circumstances are strong, only nominal damages may be given, as set out in O.C.G.A. § 51-12-4.

Necessary expenses are a recognized part of the damages estimate. See O.C.G.A. § 51-12-7. When death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses. That rule is in O.C.G.A. § 51-4-5.

Families often document funeral bills, medical bills before death, and lost income and support. Those records help show the real cost of the loss.

Who receives the money follows the statute. If there is a surviving spouse, the spouse receives no less than one-third of the recovery when children also share. See O.C.G.A. § 51-4-2(d)(2).

The recovery is also protected from the decedent’s debts. Under the same section, no recovery is subject to any debt or liability of the decedent or the estate.

Amounts vary widely from case to case. No one can say in advance what a particular claim will be worth.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How a Wrongful Death Claim Is Filed and Handled

A claim usually moves through several steps. It starts with intake, then evidence work, notice to insurers, investigation, a settlement demand, and a lawsuit if the case does not resolve.

Early intake is about the facts. The family shares who died, how, when, and who may be responsible. Preserving evidence comes next, before cars are repaired and digital records are overwritten.

The personal representative matters early. Under O.C.G.A. § 51-4-5, an administrator or executor may bring the action in the right circumstances. Court papers showing who may act for the estate may be needed before filing.

Insurers may ask for recorded statements early. Many families choose to get advice before giving one, since those words can be used later.

Many claims settle before trial. Those that do not settle may move toward a courtroom. Each step should be checked against the two-year date so the timing stays visible.

How a Wrongful Death Lawyer Is Paid

The firm handles wrongful death matters on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses.

Under this kind of arrangement, the fee comes out of a recovery. If there is no recovery, the firm does not collect a fee. Court costs and case expenses are separate, so ask how they are handled before signing anything.

T. Madden & Associates, P.C. has practiced Georgia personal injury law since 1999. The first consultation is free, confidential, and carries no obligation to continue.

For a closer look at how fees are structured, see our Georgia personal injury attorney fees guide.

Practical Steps to Take in the First Weeks After a Loss

Keep the evidence, the records, and the cost receipts from the first week. Many of these items change or disappear quickly.

Preserve the scene, the vehicle, clothing, medical devices, phones, and photos. Do not let the car be repaired or scrapped until someone has documented it.

Gather the police or incident report, the hospital and medical records, and the death certificate. Request copies as soon as they are available.

Keep a running record of funeral expenses, bills, and lost income. Note who paid each cost and when.

Before giving a recorded statement to an insurer, many families speak with a lawyer first. For more detail, see our what not to say after an injury guide.

Speak With Our Team About Your Family’s Next Step

A lawyer can help your family sort out who may file, the deadline, and what records to gather.
