The value depends on the injury, the treatment, how long recovery takes, and how the harm changes everyday life. This page explains how Georgia law treats this kind of harm, how it is organized in a claim, and which records help show it.

What pain and suffering means in a Georgia injury claim

It is the harm a person may claim for the physical and emotional effects of an injury. It is separate from medical bills and lost pay.

Under O.C.G.A. § 51-12-2, general damages are those the law presumes to flow from a wrongful act. They can be recovered without proof of any set amount. Special damages, such as medical bills, must be proved.

Pain and suffering covers two kinds of harm. Physical pain includes soreness, burning, limits on movement, and the discomfort of treatment. Emotional harm includes fear, worry, sleep trouble, and loss of enjoyment in daily life.

The concept applies across injury types. A person hurt in a car or truck crash may bring this kind of claim. So may a person hurt in a fall on unsafe property. Under O.C.G.A. § 51-3-1, an owner or occupier owes invitees a duty of ordinary care to keep the premises and approaches safe. For the broader steps in a slip and fall claim, read our slip and fall claim guide.

If you were hurt in a fall or crash, or you are trying to help someone who was, our team at T. A wrist fracture that heals in six weeks is not the same as a back injury that limits work for a year. Two people with the same diagnosis can have very different days.

The value of suffering moves with several things. These include the diagnosis, the treatment (surgery or therapy, for example), how long recovery lasts, and how the injury changes work, sleep, family life, and hobbies.

Insurance limits matter too. Each policy has a maximum it will pay. Georgia auto policies must contain uninsured motorist provisions, with limits the insured may choose under O.C.G.A. § 33-7-11. That means the coverage on a given policy can cap what is recoverable under it, although if an insurer refuses a covered loss in bad faith within 60 days after the insured makes a demand, and a bad-faith finding is made in a separate action after a judgment against the uninsured motorist, the insurer may also owe, in addition to any recovery under this Code section, a penalty of not more than 25 percent of the recovery or $25,000.00, whichever is greater, plus all reasonable attorney’s fees.

Published averages can look helpful. But an average is built from other people’s cases. It does not reflect the records, treatment, and daily limits in your claim.

How the multiplier and per diem methods work

The multiplier and per diem methods are two common ways to organize a suffering claim. Neither one produces a fixed result by itself.

The multiplier method starts with economic damages, such as medical bills. Those bills are multiplied by a number chosen to reflect how severe and how long-lasting the injury is.

The per diem method assigns a daily dollar amount to each day of pain. The daily amounts are counted across the period of recovery and added together.

These are tools for organizing evidence. They are not formulas the law requires. Insurers and courts may weigh them differently. The medical bills used in either method must also be reasonable. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. Either side may challenge that reasonableness.

Physical pain and suffering: what shows it

Physical pain is shown mainly through medical records, imaging, and treatment notes. These describe the injury and the pain the patient reported to providers.

Common slip and fall injuries include fractures, back and neck injuries, and head injuries. Pain during treatment, such as surgery recovery or physical therapy, is also part of the physical picture. So are ongoing limits on movement, broken sleep, and needing help with daily tasks.

Keep a simple written log. Note the date, your pain level, what you could not do that day, and who helped you. Write it every day or every few days. Keep it plain and factual, including both bad days and better ones.

Be careful what you say to insurers. A casual statement can be read later as part of the claim. Our page on what not to say to a personal injury attorney covers this in more detail. For how these injuries are documented, see our slip and fall injury guide.

Emotional pain and suffering: what shows it

Emotional suffering is shown through records from doctors or counselors, statements from family and friends, and a steady pattern of change over time.

Common effects include worry about returning to the place where you fell. They also include fear of driving after a crash, nightmares, sleep problems, and loss of hobbies or time with family.

Georgia law treats this kind of harm in a specific way. Under O.C.G.A. § 51-12-6, when the entire injury is to a person’s peace, happiness, or feelings, no measure can be prescribed except the enlightened consciences of impartial jurors. Punitive damages are not awarded in such an action.

Emotional harm is often underestimated. Keep the same care with it as with physical symptoms. Note counseling visits, any medicine prescribed for sleep or anxiety, and events you missed. Record changes as they happen, not from memory weeks later.

Is knee pain months after a car accident still part of a claim?

Delayed knee pain can still be part of a claim. The medical records must connect the pain to the crash, and gaps in care make that harder.

Pain can start days or months after a collision. Seeing a medical provider promptly and keeping every follow-up visit helps link the pain to the accident. The provider decides the cause of ongoing knee pain. Your records should describe the history clearly, including when the pain began and what you reported about the crash.

Timing matters as well. Georgia’s general deadline to file a personal injury lawsuit is generally two years after the right of action accrues, under O.C.G.A. § 9-3-33. Zero means no pain, and 10 means the worst pain you can imagine.

Many providers ask patients to rate pain on this scale. The number is self-reported, so it reflects what you say at that moment. When you rate pain the same way at each visit, the notes show change over time.

A single 10 does not set the value of a claim. It is one piece of the record. It sits beside the diagnosis, the treatment, and your daily limits. Give honest numbers. Do not inflate them or make them smaller to seem tougher or braver.

Which types of pain are described as the most severe?

Patients often describe nerve pain, burning or shooting pain, and pain from fractures or spinal injuries as among the most intense.

Burning, radiating, or electric-like pain can point to nerve involvement. Fracture pain is often sharp and constant. Spinal injury pain can spread into the arms or legs. Describe the exact feeling to your provider. Say where it is, what it feels like, what sets it off, and what eases it.

Two people can describe the same injury in different words. That is why records matter. Type of pain matters less than how it is documented, diagnosed, and treated.

When pain is too much to bear: when to get medical care right away

Severe or worsening pain, numbness, weakness, or trouble breathing needs emergency care right away. Do not wait to see whether it passes.

Warning signs include loss of bladder or bowel control, confusion, sudden weakness on one side of the body, a severe headache, chest pain, and trouble breathing. If you notice any of these, call 911 or go to the nearest emergency room.

Any significant pain after a fall or crash should also be checked by a medical provider. Early care protects your health. It also creates the records that document the injury. This section is medical safety guidance only.

How the claim and the record come together

A suffering claim is built from medical records, a pain log, bills, and witness statements. These pieces should agree with one another.

Medical records show the diagnosis, the treatment, and the pace of recovery. Your log shows daily life. Bills show what care cost, and they must reflect reasonable value. Statements from family or friends show how you have changed.

Georgia also reduces recovery for the injured person’s own share of fault. Under O.C.G.A. § 51-12-33, damages are reduced by that share. A person 50 percent or more at fault recovers nothing.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is a typical amount of pain and suffering?

No single typical amount exists.
