Federal hours-of-service rules limit how long a commercial driver may drive and work. Logs, electronic device data, receipts and dispatch messages can then be checked against those limits and against each other. Here is how that trail works, why it can disappear, and why timing matters in a Georgia truck crash.

What Federal Hours-of-Service Rules Require

Federal hours-of-service rules set driving limits, rest breaks and weekly work caps for property-carrying truck drivers. The main limits sit in 49 CFR Part 395.

Except as otherwise provided in § 395.1, the federal hours-of-service rule in § 395.3 requires a driver of a property-carrying commercial motor vehicle to take 10 consecutive hours off duty at the start of a work shift before getting behind the wheel. A driver also may not drive after 14 consecutive hours on duty that begin after that rest.

Breaks matter too. Driving is not allowed once more than 8 hours of driving time pass without at least a 30-minute break from driving. Weekly caps apply as well. A driver may not drive after 60 hours on duty in 7 consecutive days, or after 70 hours in 8 days, depending on whether the carrier runs every day of the week.

These limits are the baseline. Federal safety rules provide that no driver shall operate a commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate one, while the driver’s ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the commercial motor vehicle.

If a tired truck driver may have caused your crash, the records that show it don't wait, so our team is ready to talk through your options at a free, confidential first consultation. Fatigue often looks like ordinary driving mistakes.

Common signs include drifting across lane lines, braking late, missing an exit or failing to slow for traffic. A worn-out driver may not notice his own impairment. He may feel alert even when his reactions have slowed.

Certain facts from the crash itself can point toward fatigue. Think about the time of day. A crash in the early morning, after many hours behind the wheel, raises different questions than a midday crash on a short local run. Think about the trip too. Was the truck late in a long haul from another state? Did the crash happen after the driver had been working through the night?

These facts often appear in the crash report and in your own memory. Write them down while they are fresh. They help frame what records to look for.

Records That Can Show Fatigue or a Violation

The records that show fatigue are the driver’s duty-status logs, electronic device data and the paperwork of the trip. Each one can be compared with the others.

A carrier must require each driver to record duty status for every 24-hour period. Under the federal duty-status recording rule, most commercial carriers must record duty status with an electronic logging device (ELD) that meets federal requirements, and manual grid logs are allowed only under the exceptions listed in the rule. Many carriers use ELDs.

An ELD records data on its own. Under the federal ELD rules, an ELD automatically records the following data elements: date; time; CMV geographic location information; engine hours; vehicle miles; driver or authenticated user identification data; vehicle identification data; and motor carrier identification data. When the truck is moving and nothing else has been recorded for an hour, it logs an intermediate entry.

Supporting documents add a second layer. Under the federal supporting-document rule, a motor carrier must retain supporting documents generated or received in the normal course of business for each of its drivers, including each bill of lading, itinerary, schedule, or equivalent document that indicates the origin and destination of each trip. Fuel receipts, toll records, GPS data, delivery appointment times and dispatch messages can also tell a story.

Here is the comparison method. If the logs show a driver resting, but a fuel receipt, toll record or location data places the truck somewhere else, that gap matters. It can suggest the logs are inaccurate. It can also suggest the driver worked more hours than the logs admit. The same federal recording rule also states that no driver or motor carrier may make a false report in connection with a duty status.

Why Records Disappear and Why Timing Matters

Carriers must keep duty-status records for a limited time. That time can pass quickly after a crash.

That federal rule on duty-status records also requires a motor carrier to retain records of duty status and supporting documents for each of its drivers for a period of not less than 6 months from the date of receipt. Six months is a minimum. It is not a promise that everything stays longer.

Supporting documents have a cap too. The federal supporting-document rule also provides that a motor carrier need not retain more than eight supporting documents for an individual driver’s 24-hour period. If it has more than eight, it must keep the ones with the earliest and latest times. Some paper from a busy day can therefore be discarded under the rules.

A written preservation request sent early helps. It asks the carrier to hold logs, ELD files, dispatch messages and receipts while the claim is still forming. Waiting weeks can mean lost paper or overwritten files.

The crash scene and the truck itself also change. Skid marks fade, repairs begin and drivers give their accounts. Early action keeps more of the trail intact.

How Fatigue Evidence Fits Into a Georgia Claim

Hours-of-service records are one part of a Georgia truck crash claim. They sit alongside the crash report, vehicle damage, witness statements and medical records.

Georgia’s Code gives state regulators power to adopt safety rules for motor carriers and drivers. Those rules can include the hours-of-service and record-of-duty-status requirements of 49 CFR Part 395. Georgia law gives the commissioner of public safety authority to adopt rules for the safe operation of motor carriers, commercial motor vehicles and drivers, and the safe transportation of hazardous materials. Relying on the rulemaking power granted in O.C.G.A. § 40-1-8, Georgia’s Department of Public Safety has adopted the federal motor carrier safety regulations, including the hours-of-service and record-of-duty-status requirements of 49 CFR Part 395, as rules for motor carriers operating in the state. That means the federal logging rules carry weight in Georgia.

It can also bear on the carrier’s own choices, such as scheduling, dispatch pressure or how it tracked hours. Those points depend on what the records actually show.

Keep the limits in mind.

Georgia’s Two-Year Filing Deadline

Georgia generally gives two years to sue for injuries to a person (O.C.G.A. § 9-3-33; Cameron v. JMP Pizza, Inc. (2026)).

The statute begins with “except as otherwise provided,” so other periods can apply to some claims. That is one reason to get advice early rather than guess.

Gathering records takes time. Write down the date of the crash today. Plan your timeline around that date, not around when the logs arrive.

Families have a separate path after a fatal crash. Write down what you remember while it is fresh. Save photos, medical bills and receipts. Track time lost from work, and keep a simple note of pain and limits in daily life.

Be careful with the trucking company’s insurer.
