There is no single average that fits. Each settlement depends on the injuries, the fault, the insurance, and the costs in that one crash. This page explains why published averages can mislead, which Georgia rules shape value, and what to weigh if you’re dealing with a crash involving a truck, delivery van, or company fleet vehicle.

Why a Single Average Settlement Figure Can Mislead

One average rarely fits one crash, because each settlement reflects that crash’s own facts.

A settlement is the agreed payment that resolves a claim. Its size comes from the injuries, the medical bills and lost work that follow, who was at fault, and how much insurance is available. Two people hurt in the same collision can have very different claims, because their injuries are not the same.

Many people who search this question are researching for someone else. You might be a spouse, a child, or a friend trying to understand what a claim involves. Commercial crashes bring insurance calls, bills, and questions about work. That can feel overwhelming when you’re also trying to heal.

Use this page to learn what moves the number, not as a promise of what any claim will pay. For the wider picture, read our truck accident claims guide.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How to Read the Published Settlement Ranges

A published range helps only when you know which injuries and which fault facts it describes.

You’ll see ranges for car crashes, truck crashes, head-on collisions, and company vehicles. These ranges often describe different injury levels and different fault situations, so they aren’t directly comparable. A low range may describe a minor soft-tissue injury with clear fault. A high range may describe a catastrophic injury or a death. Before you compare numbers, ask what kind of injury and what kind of fault the range describes.

Learn the difference between a gross settlement and what the injured person actually receives. The gross figure is the total agreed to resolve the claim. From that total, medical liens, repayments, and other deductions may be paid. A headline number can shrink a lot before money reaches the injured person.

Settlements are usually reached through negotiation. They aren’t set by a fixed table based on vehicle type alone. Two claims involving the same kind of truck can resolve differently, because the medical records, proof of fault, and insurance limits differ.

Factors That Move the Value of a Commercial Vehicle Claim

Injury severity, fault, insurance limits, and the number of responsible parties push a claim’s value up or down.

Injury severity. Diagnosis, imaging, surgery, hospital stays, and whether the injury is permanent or long-term all shape the claim. Records that show how the injury affects a person over time usually carry more weight than a single visit.

Fault and how the crash happened. Investigators look at the driver’s conduct, company practices, and vehicle maintenance. Some crash types, such as a jackknife, raise their own questions about how the crash is treated.

Insurance limits. Federal rules set minimum public liability levels for many commercial carriers. For example, the federal minimum schedule sets $750,000 for for-hire carriage of nonhazardous property in interstate or foreign commerce, in vehicles rated 10,001 pounds or more. Carriers may carry more than the minimum, and the available coverage shapes what a claim can realistically resolve.

Several responsible parties. The driver, the trucking company, a broker, and others may each carry insurance.

Georgia Rules That Shape the Final Number

Georgia’s fault rules can reduce a claim or bar it, so the percentage of fault matters as much as the injuries.

Georgia applies a modified comparative negligence rule, which is a shared-fault rule. A judge reduces damages in proportion to the injured person’s share of fault, under O.C.G.A. § 51-12-33(a). If that share is 50 percent or more, the person may not receive any damages, under § 51-12-33(g).

Under § 51-12-33(c), the fault of every person who contributed to the injury is generally weighed, not just that of the parties sued. A nonparty’s fault is considered when the plaintiff settled with that nonparty or when a defendant gives the notice required by subsection (d). Each liable person answers for its own apportioned share, not a joint share, under § 51-12-33(b).

Georgia also sets a deadline. Under O.C.G.A. § 9-3-33, most injury claims must generally be brought within two years after the right of action accrues.

Punitive damages, which punish rather than compensate, are capped at $250,000 in most tort cases outside the exceptions. The cap is set in O.C.G.A. § 51-12-5.1(g). Under § 51-12-5.1(f), the cap does not apply in two situations. The first is where the defendant acted with specific intent to cause harm. The second is where the defendant acted while under the influence of alcohol, drugs other than lawfully prescribed drugs taken as prescribed, or intentionally consumed toxic vapors, to a degree that substantially impaired the defendant’s judgment.

Every claim runs through these rules. The same injury can carry a different value depending on fault and timing.

Medical Costs, Lost Wages, Property Damage, and Pain and Suffering

A claim usually covers medical bills, lost income, vehicle damage, and pain and suffering, and each one is proven differently.

Medical expenses. When health insurance is involved, the evidence can include both the amounts charged and the amounts actually needed to satisfy those charges under the insurance contract, under § 51-12-1.1(c).

Treatment on a letter of protection. Some providers treat an injured person and wait for payment from a settlement. Under § 51-12-1.1(d), the letter, the itemized charges, and any sale of those bills to a third party below invoice price can be requested in the case.

Lost wages and property. Lost income is documented with pay records, employer information, and notes on work restrictions. Vehicle repair or replacement and damaged personal items are often handled separately from the injury claim.

Pain and suffering. Non-economic damages reflect how the injury changes daily life, sleep, work, and family routines. No fixed formula sets this amount. Gaps in treatment and missing records give the other side something to question, so keeping appointments and records matters.

What a Settlement Agreement Ends and What It Can Leave Open

A signed settlement agreement usually closes the claim, so you need to know its terms before you sign.

Read the release line by line. It generally ends further claims over the same crash. Ask what it covers, whether it includes property damage, and whether future care is addressed.

Health plans and government programs may hold repayment claims that must be resolved from the settlement money. Those claims are separate from the amount you negotiate, so they should be addressed before money is paid out.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is considered a serious injury in a Georgia car accident?

Severity depends on the facts, including the diagnosis, the treatment needed, and how long the injury affects daily life and work.
