Punitive damages are capped at $250,000 in most cases, but the cap has exceptions. The $350,000 limit on non-economic damages in O.C.G.A. § 51-13-1 applies to medical malpractice actions, not truck crash claims.

O.C.G.A. § 51-12-2 describes general damages as losses the law presumes flow from a wrongful act. Special damages actually flow from the act, and you must prove them. Bills and pay records are the proof you’ll usually need for out-of-pocket losses. Whether a specific item is recoverable depends on the facts of the crash and the parties involved.

Economic damages in a Georgia truck crash claim

Economic damages are money losses you can count and prove with paperwork. Medical care, prescriptions, rehabilitation, medical devices, lost wages, and damage to your vehicle or belongings all fall in this group. Future losses can count too.

Future money is adjusted to today’s value. Under O.C.G.A. § 51-12-13, the trier of fact may reduce future medical expenses, lost wages, and similar losses to present value. It may use a 5 percent discount rate or another rate it considers appropriate. A long-term injury makes careful records on lost earning ability even more important.

Medical bills get special treatment. O.C.G.A. § 51-12-1.1 limits medical expense damages to the reasonable value of medically necessary care. If you have any form of public or private health insurance, including benefits under a governmental workers’ compensation program, the evidence must include both the amounts charged for your medical and healthcare expenses and the amounts actually necessary to satisfy those charges under the insurance contract, whether or not the insurance is used. The sticker price on a bill isn’t the whole story.

Start your records on day one. Keep every bill, receipt, prescription slip, and appointment summary. Keep a simple log of missed work and daily tasks you can’t do. The Georgia Office of the Commissioner of Insurance advises collecting accident and witness information and documenting the scene soon after a crash, as described in its Georgia insurance auto claim tips.

Non-economic damages: pain, suffering, and loss of enjoyment

Non-economic damages pay for harm that doesn’t come with a receipt. These include physical pain, emotional distress, anxiety, scarring, and loss of enjoyment of life. These losses can be as serious as the bills, and they often last longer.

Georgia’s statute defines non-economic damages broadly. It includes items such as mental anguish, disfigurement, and loss of society and companionship, as listed in O.C.G.A. § 51-13-1. By its terms, O.C.G.A. § 51-13-1 addresses noneconomic damages in a verdict or judgment “in a medical malpractice action, including an action for wrongful death,” against health care providers or medical facilities.

Two other rules matter here. If the entire injury is to your peace, happiness, or feelings, O.C.G.A. § 51-12-6 says no measure can be set except the consciences of impartial jurors. Also, if an injury is small or mitigating circumstances are strong, O.C.G.A. § 51-12-4 allows only nominal damages.

Jurors usually learn how an injury changes daily life through medical records and testimony from people who know you. Those facts carry the weight in this category.

Punitive damages and the $250,000 cap explained

Punitive damages punish a defendant for serious misconduct. They don’t pay you back for a loss. Under O.C.G.A. § 51-12-5.1, punitive damages are awarded “not as compensation to a plaintiff but solely to punish, penalize, or deter a defendant.”

The claim must be specifically asked for in the complaint. The jury first decides whether punitive damages will be awarded at all. In most tort cases that don’t involve product liability, the maximum is $250,000.

The cap has exceptions. There is no dollar limit against an active tort-feasor who acted with specific intent to cause harm. The exception also applies when the defendant was under the influence of alcohol or of drugs other than lawfully prescribed drugs administered in accordance with prescription, to the degree that his or her judgment is substantially impaired; under O.C.G.A. § 51-12-5.1(f), such damages shall not be the liability of any defendant other than an active tort-feasor. A product liability claim, such as one against a parts maker, follows a different subsection with no dollar limit.

Impairment questions often turn on testing. Federal rules require post-accident drug and alcohol testing for commercial truck drivers. Whether punitive damages are pursued depends on the conduct involved and the evidence available.

How Georgia’s comparative fault rule can reduce what you recover

Under Georgia’s comparative fault rule, your recovery drops by your share of fault. O.C.G.A. § 51-12-33 says the judge reduces damages in proportion to your percentage of fault. If you are 50 percent or more responsible, you cannot recover damages under that statute.

The same statute says each liable person owes only its own share. That share is not joint liability. The fact-finder also considers the fault of everyone who contributed to the injury, even people who were never sued.

Fault is often disputed after a truck crash. The National Transportation Safety Board’s accident report summaries identify probable causes and safety recommendations, but they do not determine fault or liability. Georgia’s official Uniform Vehicle Accident Report form records the crash data used later.
