Each one turns on its own facts, and each one ends by settlement, verdict, or dismissal. Below, we explain why one number can mislead and which facts and deadlines shape the path forward. T. Madden & Associates, P.C. has been in practice since 1999.

Why a single success rate number does not describe wrongful death cases

A single success rate would average together very different situations. That average would not help your family.

One case may involve a crash on a highway. Another may involve a fall, a medical error, or violence on a property with weak security. Each has different facts, different defendants, and different harm. Averaging them hides those differences.

Courts and lawyers usually describe these cases by how they ended. A case settled, went to a verdict, or was dismissed. Each ending has its own terms and its own meaning for the family.

This is a painful time to look for clear answers. A better question is what facts decided cases like yours.

If you are sorting out what happened to someone you loved, you don't have to work through the questions alone. The parties negotiate the amount. The written terms set out how any money is divided among eligible family members. Under O.C.G.A. § 51-4-2, the surviving spouse receives no less than one-third of the recovery.

A verdict happens after trial. A judge or jury decides who is at fault and what the damages are. A verdict can favor the family, favor the other side, or land somewhere between.

A dismissal ends the case without a trial. A case can also end with a smaller recovery than the family hoped for. Knowing that is possible helps families plan.

How the facts of a case shape what a claim can recover

Under Georgia law, a surviving spouse may bring a wrongful death claim. If there is no surviving spouse, a child or children may bring it. The recovery is the full value of the life of the decedent, as shown by the evidence.

If no one is entitled to sue, the estate’s administrator or executor may bring the action for the next of kin. When death results from a crime or other negligence, the personal representative may also recover funeral, medical, and other necessary expenses under O.C.G.A. § 51-4-5.

Medical expenses must be proven. When death results from a crime or from criminal or other negligence, the personal representative of the deceased person is entitled to recover the funeral, medical, and other necessary expenses resulting from the injury and death of the deceased person, under O.C.G.A. § 51-4-5.

Fault also matters. Damages are reduced in proportion to the plaintiff’s share of fault. A plaintiff who is 50 percent or more responsible for the injury or damages recovers nothing, under O.C.G.A. § 51-12-33. Police reports, witness statements, and medical records often shape how a claim looks early on. The strength of each claim depends on the facts of the case.

Deadlines and evidence that affect the outcome

Georgia’s general time limit for injury claims is two years after the right of action accrues. That rule comes from O.C.G.A. § 9-3-33. Other rules can change the timing.

Claims against the state work differently. Written notice of the claim is required within 12 months of when the loss was discovered or should have been discovered. No suit can start until the Department of Administrative Services denies the claim or more than 90 days pass. See O.C.G.A. § 50-21-26.

Early evidence matters. Keep the vehicle or device if you still have it. Save photos, phone records, and medical files. Evidence can be lost or changed as time passes.

T.
