Here is the short answer. Many Georgia accident lawyers work on a contingency fee, which is a percentage of the money recovered. There is no single rate for every claim. The percentage is set in a written agreement, it can change with the stage of the case, and case expenses are a separate question. This page walks through each part, using a hypothetical example, for someone helping an injured family member or friend.

Why the Question Is Hard to Answer With One Number

There is no single percentage for every accident claim. Fees are set one case at a time, in the agreement between the injured person and the lawyer.

This question usually comes up after a crash. A parent, spouse, or friend is trying to figure out what a lawyer would keep from a recovery. Often the injured person is still healing, and the family is juggling bills and time off work. That is a hard moment to do the math.

This page does not give one figure for what accident lawyers charge in general. Instead, it breaks the answer into three parts: the percentage, the stage of the case, and the case expenses. Each one changes what the injured person ends up with.

Fault matters too. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s share of fault. A plaintiff who is 50 percent or more responsible recovers nothing. That shrinks the total before any fee comes out of it. Quynn v. Hulsey explains Georgia’s modified comparative fault rule.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How a Contingency Fee Works

A contingency fee is a share of the money recovered, and it is paid only when the case produces a recovery. The lawyer’s fee comes out of the result, not out of hourly bills.

T. Madden & Associates, P.C. handles these cases on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses.

Two things are true at once. The fee is tied to the result. The costs of the case are a different line item. Think of the fee as one line on a settlement statement and case costs as another.

The firm’s first consultation is free, confidential, and carries no obligation to continue. That means you can ask how the fee works before you decide anything. Write your questions down, and ask the lawyer to explain each answer in plain words.

Why the Percentage Can Change by Stage

The percentage can differ depending on how far the case goes. Agreements often set one rate for a settlement reached before a lawsuit is filed, and a different rate if the case is filed, tried, or appealed.

The reason is effort. A case that goes to court usually involves more steps, such as formal discovery, motions, and trial preparation. The written agreement is where each stage and its rate get spelled out.

When you read an agreement, look for each stage by name. Check what percentage applies at settlement, at filing, at trial, and on appeal. If a term is unclear, ask the lawyer to explain it before you sign.

A common mistake is assuming one number covers every stage. Another is not asking which stage applies when a settlement offer arrives. That question matters once an offer is on the table.

Fees Versus Case Expenses: Why Both Matter

Case expenses are the costs of building and running the case, and they are separate from the lawyer’s fee. Common examples include filing fees, copies of medical records, reports from treating providers, and deposition costs.

Georgia’s damages statute treats necessary expenses from an injury as a legitimate part of the damages estimate, under O.C.G.A. § 51-12-7. That is about what the injured person can claim. It is a different question from who covers the case costs during the claim.

Medical bills raise a related point. If treatment is provided under a letter of protection, Georgia law makes the letter, itemized charges, referral details, and, if the provider sells the accounts receivable to a third party at less than the invoice price, the dollar amount the third party paid for them relevant and discoverable, under O.C.G.A. § 51-12-1.1.

The written agreement should say how expenses come out of the recovery. The order matters, as the next section shows.

A Hypothetical Calculation to Show How the Numbers Interact

This example is hypothetical. The settlement, fee percentage, and expenses are invented for illustration. They are not this firm’s rates or a typical fee.

Assume a $90,000 settlement, a 30 percent fee, and $6,000 in case expenses.

Order one: expenses come out first. Subtract $6,000 from $90,000 to get $84,000. The fee is 30 percent of $84,000, or $25,200. The client nets $58,800.

Order two: the fee is figured on the full settlement. The fee is 30 percent of $90,000, or $27,000. Subtract that fee and the $6,000 in expenses. The client nets $57,000.

The difference is $1,800. Only the order of subtraction changed. The settlement, percentage, and expenses stayed the same.

Real cases also include medical liens, property damage, and other claims that this simple math leaves out. Actual numbers come from the written agreement and the facts of the case.

Talking With a Lawyer About Your Situation

If someone you care about was hurt in a car wreck, a truck crash, an e-bike fall, or a slip on someone else’s property, you may be the one asking these questions.
