Most of the time it means the electronic logging device (ELD) and the engine’s control module. These devices can hold records that show what the truck and driver were doing before a crash. So the question of what is a black box in a semi truck and why does it matter comes down to timing. The data can help explain hours, location and operating events, but it can be lost if no one asks for it to be kept.

What Is a Black Box in a Semi Truck?

A semi’s black box is not one device. It is a nickname for several recording systems on the truck.

The main one for most trucks is the electronic logging device. Under 49 C.F.R. § 395.8, a motor carrier subject to the requirements of this part must require each driver used by the motor carrier to record the driver’s duty status for each 24-hour period, except for a private motor carrier of passengers (nonbusiness). 49 C.F.R. § 395.20 provides that an ELD used after December 18, 2017 must meet the requirements of this subpart.

A second source is the engine control module. It runs the engine and can log how the engine operated. Engine data recorders work in a similar way. The equipment varies by truck, make, model and carrier, so each truck’s setup has to be confirmed.

The ELD tracks driving time and duty status. The engine module tracks engine activity. These are different sources, and each can answer different questions after a crash.

If a semi truck crash has you wondering whether its electronic logs still exist, our team can talk it through with you in a free, confidential consultation. The driver does not have to type them in.

Under 49 C.F.R. § 395.26, the ELD automatically records the date, time, truck location, engine hours, vehicle miles, and driver, vehicle and carrier identification. It records these when a driver indicates a change of duty status. When the truck is moving and no other entry has been made in the past hour, it adds an intermediate entry.

Engine and control-module data can add more detail. Depending on the equipment, it may include speed, braking events and engine activity. Which items exist depends on the truck, so the records must be checked, not assumed.

The data is most useful next to other evidence. A driver’s account, dispatch records, fuel receipts and the crash report each tell part of the story. The logs carry the most weight when they line up with those sources. When they don’t, the gap itself becomes a question to answer.

Why the Electronic Logs Matter After a Crash

Electronic logs can show whether a driver was within allowed driving and rest time when the crash happened.

Federal hours-of-service rules limit driving time and require rest breaks. The FMCSA hours-of-service rules page covers those limits, including rest breaks, driving limits and sleeper-berth provisions. An ELD record shows how the driver’s time was logged against those limits.

Speed and braking data, where the truck has it, can help rebuild the seconds before impact. That helps test what the driver said happened and what witnesses recall.

Carriers keep paperwork too. Together, they show the whole trip, not just one moment.

Records across several trips can sometimes show patterns beyond a single run. That is one reason to ask for more than one day’s data.

Why Timing Matters: Data Can Be Overwritten

The carrier controls the truck and the records, so a written request asking the company to keep them matters.

Federal rules protect original data while it is kept. Under 49 C.F.R. § 395.30, a motor carrier must not alter or erase the original hours-of-service information, the source data streams, or information in an ELD that uses that original information. That protection does not mean the records are kept forever.

Federal retention rules set minimum periods. Under 49 C.F.R. § 379.3, companies subject to this part must retain records for the minimum retention periods provided in appendix A to this part. After those periods, records may be destroyed at the discretion of each company’s management, but this does not excuse compliance with the lawful requirements of any other governmental body prescribing longer retention periods for any category of records.

Trucks get repaired and put back on the road. Another driver may take the rig. Devices can be cleared or replaced through normal use. Files can also move to another yard or office. Each change can affect what data remains.

If you were hurt, write down what you saw the same day. The crash-scene notes guide lists what helps.

Georgia’s Deadline to File and Why Preservation Comes First

Georgia’s general deadline to file an injury lawsuit is two years (O.C.G.A. § 9-3-33; Kenneth B. Cameron v. Jmp Pizza, Inc (2026)).

Under O.C.G.A. § 9-3-33, actions for injuries to the person generally must be brought within two years after the right of action accrues, except as otherwise provided in that article, such as actions involving loss of consortium, which must be brought within four years, and injuries to reputation, which must be brought within one year. The statute begins with “except as otherwise provided,” so other rules in that article can apply.

Filing on time is one step. Preserving evidence is another, and it often comes first. Truck data can be lost well before a filing date arrives. Waiting can leave gaps.

Government vehicles follow shorter notice rules. A claim against a city must be presented in writing to the governing authority within six months of the event. O.C.G.A. § 36-33-5 sets that time and the details the claim must include. A claim against the State must be given in writing within 12 months of when the loss was discovered or should have been discovered, under O.C.G.A. § 50-21-26.

An insurer’s early call or quick offer does not replace these steps. The insurer denial guide explains more.

How the Firm Handles a Data Preservation Request

Our team sends a written preservation request to the trucking company and its insurer. It asks them to keep the truck’s data and related files.

The request usually names the records. It can include ELD and engine data, dispatch and maintenance records, driver files, bills of lading and fuel receipts. Each item is tied to the trip and the date of the crash.

Terance Madden is the responsible lawyer for this page. T. Madden & Associates, P.C. has practiced since 1999. The firm handles truck accident matters, including these requests.

Our lawyers and support staff track which records have been requested, when the request was sent, and when a follow-up is due.
