In Georgia, a trucking insurer’s first answer is a position it can revisit with evidence.

Trucking insurers often respond to injury claims in one of three ways. They may deny the claim, ask for more information, or make a low first offer. Each of these is a step in a negotiation, not a final decision.

So can the trucking company’s insurer deny my claim? Yes, it can deny it. But a denial starts a dispute, and Georgia’s fault rules and filing deadline shape how that dispute goes. This page explains both, along with the defenses carriers raise and how a denial can be reviewed. Under O.C.G.A. § 51-12-33, the judge reduces the damages awarded to you in proportion to your percentage of fault. The same statute says you cannot receive any damages if you are 50 percent or more responsible for the injury or damages claimed.

This is why many denials focus on blame rather than on your injuries. If the carrier can shift fault onto you, the amount it owes you drops, or the claim ends altogether.

Fault is decided on the facts of the crash. Insurers argue over lane position, speed, following distance, and turn signals. Each argument is a claim, not a final finding. You answer it with evidence, such as the police report, photos, witness statements, and any vehicle or dashcam data.

The statute also shapes who pays. Damages are split among the people found liable, and each person owes only their own share. The jury or judge must also consider the fault of everyone who contributed to the injury, even people who were never named in the suit. A defendant can point to a nonparty if the plaintiff entered into a settlement agreement with the nonparty, or if the defendant gives notice by filing a pleading in the action that names the nonparty and gives a brief statement of the basis for believing the nonparty at fault, not later than 120 days before trial.

A fault argument is a negotiating position. What matters is whether the evidence supports it.

The Two-Year Deadline to File Under O.C.G.A. § 9-3-33

Georgia generally requires a lawsuit for injuries to the person to be brought within two years after the right of action accrues. That rule comes from O.C.G.A. § 9-3-33. The statute has exceptions, so the dates in your case need a careful check.

Except as otherwise provided in this article, actions for injuries to the person shall be brought within two years after the right of action accrues, except for injuries to the reputation, which shall be brought within one year after the right of action accrues, and except for actions for injuries to the person involving loss of consortium, which shall be brought within four years after the right of action accrues (O.C.G.A. § 9-3-33).

Waiting for the carrier’s final word before checking dates is a risk. Start one simple note with the crash date and the date of every letter from the carrier. Then count forward from the crash.

Common Defenses Carriers Raise After a Semi Crash

Carriers usually raise defenses in a few groups. Each one can be answered with evidence, and the same facts can support or weaken a defense. The Georgia Department of Public Safety lists driver error, inadequate rest, defective brakes, and defective steering among common contributing factors in commercial truck crashes, per its Georgia DPS truck crash fact sheet.

Liability. The carrier says the truck driver was not at fault, or that another driver or road condition caused the crash.

Comparative fault. The carrier says you changed lanes, were speeding, or were distracted. Under § 51-12-33, any share of fault reduces your recovery.

Who is responsible for the truck. Under O.C.G.A. § 51-2-2, a person can be liable for wrongs done by a servant within the scope of that person’s business. Carriers may argue the driver was off the job or that a contractor or lessor controls the truck. Federal rules require a truck lease to spell out who must carry insurance, under 49 C.F.R. § 376.12.

Broker claims.

Injury severity. The carrier argues the injury is minor, pre-existing, or unrelated to the crash.

Treatment gaps. The carrier uses breaks in care to argue the injury was not serious.

Coverage limits. Federal rules set a minimum. 49 C.F.R. § 387.9 lists $750,000 for for-hire carriers hauling nonhazardous property in interstate or foreign commerce, with a gross vehicle weight rating of 10,001 or more pounds. The policy itself sets the actual limit.

How Our Team Reviews a Denial or Low Offer

Our team reviews a denial by checking each reason the carrier gives against the evidence in the file. We start with the denial letter or low offer, the police report, photos, and any dashcam or vehicle data. We add medical records and the carrier’s written reasons. Then we compare each reason with what the record shows.

Terance Madden is the responsible lawyer for this page. T. Madden & Associates, P.C. has been in practice since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon, and Augusta. Our lawyers handle these claims on a no-fee-unless-we-win basis. You may still be responsible for court costs and case expenses.

The review can lead to a few paths. We may send a renewed demand with added proof, gather more documentation, or file a lawsuit before the deadline. The path depends on what the file shows.

Protecting Your Claim While the Insurer Decides

Good records now help answer fault arguments later. Write down the location, lane, weather, and any witness names while they are fresh. Save photos of the scene and your vehicle.

Keep every letter from the carrier in one folder. Read any release before you sign it, and don’t accept a payment without reviewing what it closes. A signed release can end the claim.

Keep your medical appointments and follow the treatment plan your doctor gives you. Gaps in care are a common carrier argument, so a steady record matters.

Be careful with recorded statements. A statement you give to an adjuster can be used in the claim. Keep early calls short and factual. If a call feels rushed, you can say you need time to review your records.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Frequently Asked Questions About Insurer Denials After a Semi Crash in Georgia
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can the insurer deny my claim even if the truck driver got a ticket?

Yes.
