When your losses climb past that number, the gap can shape every decision that follows. This page explains how a truck accident lawyer in Georgia reviews commercial insurance policy limits, and which other coverage may add to recovery.

What Trucking Company Insurance Policy Limits Mean After a Georgia Truck Crash

A policy limit is the most the liability insurer must pay for covered injuries and property damage from one accident.

Think of the limit as the insurer’s cap. It is not a measure of what your claim is worth. Two people hurt in the same crash can have very different losses, and one policy may have to cover both.

Policies can work in different ways. Some set a limit for each accident. Others also carry a total limit for the whole policy period, so earlier claims can use up part of it.

This section is for crash victims and families who suspect the carrier’s coverage will not be enough. If that’s you, the limit is the first number to check, not the last.

If a loaded truck left you or a family member facing medical bills and an insurer's offer before the full picture is clear, talk with our team about every layer of coverage. The minimum levels of financial responsibility referred to in § 387.7 are set out in Table 1 to 49 C.F.R. § 387.9, which sets limits by type of carriage and commodity, including hazardous substances transported in bulk.

Under 49 CFR 387.7, a motor carrier may not operate a vehicle until these minimum levels are in effect.

A minimum is a floor, not a ceiling. A serious injury, a wrongful death or a catastrophic injury can produce losses above $750,000. When that happens, the policy itself and any other coverage need a close review.

Other Coverage and Parties That May Add to Recovery

Other coverage and other responsible parties can add to recovery when the primary policy falls short.

Excess and umbrella policies. These sit above the primary auto liability limit and can add coverage once that limit is used up.

Your own coverage. According to the Insurance Information Institute, uninsured and underinsured motorist coverage may reimburse policyholders after accidents involving uninsured, underinsured or hit-and-run drivers.

The trucking company. Under O.C.G.A. § 51-2-2, a person is liable for torts committed by a servant within the scope of that person’s business.

Contractors. Under O.C.G.A. § 51-2-5, an employer can answer for a contractor’s negligence in listed situations, such as when it keeps the right to direct how the work is done.

Brokers.

Fault is divided too. Each liable party pays its own share, and there is no joint liability. A defendant can also name a nonparty as at fault if it gives notice at least 120 days before trial.

How We Pursue the Policy Limits: Steps and Timeline

A typical review starts with a free consultation, then works through every policy that may apply.

Free first consultation. We review the crash, your injuries and any paperwork you already have.

Preservation letters. Early letters ask the carrier and driver to keep driver logs, dash camera footage, maintenance files and dispatch messages. Federal hours-of-service rules set driving limits and rest breaks for commercial drivers. The Georgia Motor Carrier Compliance Division describes the time records used to show whether a driver exceeded those limits.

Crash report and evidence. We obtain the official crash report and compare it with photos and witness statements.

Every policy. We check for excess and umbrella coverage and for other responsible parties.

Full damages. We document medical care, lost income and future care needs, so the full claim can be measured against available coverage.

Demand, then suit. A settlement demand comes first. If the claim cannot be resolved fairly, a lawsuit may be filed. Georgia generally allows two years for injury claims under O.C.G.A. § 9-3-33, except that injuries to the reputation must be brought within one year, and actions for injuries to the person involving loss of consortium must be brought within four years, so timing matters.

Timing varies with the injuries and with whether the claim settles or goes to court.

Compensation That Can Be at Stake When Damages Exceed Limits

Georgia separates general damages, which the law presumes from a tortious act, from special damages, which must be proved, under O.C.G.A. § 51-12-2.

Special damages: medical bills, rehabilitation, lost wages, loss of earning capacity and property damage.

General damages: pain and suffering, disfigurement, loss of enjoyment of life and emotional distress.

Wrongful death: When a death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical and other necessary expenses under O.C.G.A. § 51-4-5.

Catastrophic injuries: Spinal cord damage, traumatic brain injury and amputation often bring large future care costs. These cases often call for review of every available policy.

How a claim is valued depends on the facts of your case.
