Most lost income is recovered through a claim against the at-fault driver’s liability insurance. Coverage on your own policy may also help, depending on what you bought.

Lost wages are one part of an injury claim. A claim can also include medical bills, other necessary expenses, and pain and suffering. Whether a claim pays lost wages, and how much, depends on the facts of the crash and the coverage involved.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does car insurance pay for loss of wages if I was partly at fault?

Georgia reduces damages in proportion to the injured person’s share of fault. This coverage pays for injuries the other driver caused, up to the policy’s limit. The limit is the most the insurer will pay under that policy.

Medical payments coverage (MedPay) works differently. If your own policy includes it, it can pay certain accident-related costs no matter who caused the crash. Its benefits have set limits, so it may not cover all of your lost income.

Uninsured and underinsured motorist coverage can apply when the at-fault driver has no insurance or not enough insurance.

Health insurance and disability benefits are separate from auto coverage. They follow their own rules, so review those plans on their own terms.

What qualifies as lost wages

Lost wages are the income you lose because of your injuries. Lost income is one of the losses a person may describe after an injury. Under O.C.G.A. § 51-12-2, special damages “actually flow from a tortious act” and “must be proved in order to be recovered.”

Common examples include:

Scheduled shifts and overtime you actually missed during recovery.

Reduced hours, or a move to lighter duty at lower pay, caused by the injury.

Paid time off, sick days, or vacation you used because of the crash.

Time away from work for medical visits.

Future income can also be part of a claim. If injuries affect your ability to earn over time, that loss may count. Under O.C.G.A. § 51-12-13, the judge or jury may reduce future economic losses, such as lost wages, to present value. The statute allows a 5 percent discount rate or any other rate the fact-finder considers appropriate. In plain terms, money paid today is worth more than the same amount paid years later.

Self-employed people, gig workers, and those who earn tips need clear records. There is no pay stub to point to, so the numbers must be shown another way.

How lost wages are documented

Good records do most of the work in an income claim. Pay stubs from the weeks before and after the crash show your usual pay. W-2s or tax returns show a yearly pattern, which matters most when your pay changes from week to week.

Ask your employer for a letter that confirms the dates you missed, your rate of pay, and any lost benefits. Providers’ notes that describe work restrictions and the dates they applied help show why you missed work.

Keep a simple written log of missed shifts, appointments, and symptoms as your recovery unfolds. A log written at the time is easier to support than memory alone. Costs of getting to appointments may also count. Under Georgia law, “necessary expenses consequent upon an injury are a legitimate item in the estimate of damages,” according to O.C.G.A. § 51-12-7.

Start gathering these records early, before dates and details blur.

What not to tell your insurance company

An adjuster may ask for a recorded statement soon after the crash. You don’t have to give one right away. It’s reasonable to wait until you understand your injuries and your claim.

Describe only what you know. Avoid guessing about your injuries, your return-to-work date, or how the crash happened. Guesses can be used later to argue about fault.

Insurers may argue that you share some of the blame. Georgia reduces damages by your percentage of fault, and if you are 50 percent or more responsible, you are not entitled to receive any damages, as explained in O.C.G.A. § 51-12-33. Careful, accurate answers matter for that reason.

Don’t sign a broad release or accept a settlement offer before the full extent of your lost income is clear. Future wage losses may not be visible yet, so an early offer may not reflect them. Keep copies of everything sent to or received from the insurer, including emails, letters, and payment offers.

Lost wages in a truck accident claim

Truck crashes often involve larger policies and more parties. That changes how lost income is recovered. Trucking companies carry commercial policies, and those policy limits shape how much is available for lost income and other damages.

Federal rules set a floor. Under 49 CFR 387.9, the minimum financial responsibility for for-hire carriage of nonhazardous property in interstate or foreign commerce, at a gross vehicle weight rating of 10,001 pounds or more, is $750,000. That figure is a minimum. It is not a measure of what any claim is worth.

Several parties can be involved, including the driver, the carrier, and sometimes the vehicle owner. Each may have its own insurer. Under Georgia’s apportionment rule in O.C.G.A. § 51-12-33, each liable person’s share is its own, and it is not joint liability.

Driver logs and maintenance files may matter to the claim. They can be requested as the case develops. For the broader process, read our guide to truck accident claims in Georgia.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How a spouse or family member may be affected

A spouse may have a separate claim tied to the injured person’s case. Actions involving loss of consortium must be brought within four years after the right of action accrues.

Because the time limits differ, a family member should not assume they share the same deadline. Deadlines are easy to miss when a family is focused on recovery.

Family members who handle bills or missed work for an injured relative should keep their own records of time and expenses. A relative who drives the injured person to appointments can track mileage, parking, and time away from their own job.

Talk with T.
