Not automatically. Your spouse may still have a claim of their own, and a divorce can bring a settlement into a property discussion.

Short answer: who owns a Georgia personal injury settlement

Your own rights are a separate question. Georgia lets an uninjured spouse bring a loss of consortium claim, which covers the harm the injury does to the marriage. Whether you have that claim depends on the facts of the injury and your family’s situation.

There is also a second question: how a settlement is divided if the couple divorces. These two questions work differently. Keep them apart when you read about your case, so you don’t mix up whose money is at stake.

Loss of consortium: the spouse’s own claim in Georgia

Loss of consortium is the uninjured spouse’s claim for the effect of the injury on the marriage. The value of the claim turns on how the injury changed daily married life.

It is a separate claim from the injured spouse’s claim. The money does not come out of the same bucket. Georgia generally requires actions for injuries to the person to be brought within two years after the right of action accrues, but actions for injuries to the person involving loss of consortium must be brought within four years after the right of action accrues (O.C.G.A. § 9-3-33). The injury claim itself generally has two years, under O.C.G.A. § 9-3-33.

Truck crashes add layers. When a commercial truck is involved, more parties may share responsibility, and the paperwork gets heavier. Our overview of truck accident claims in Georgia explains how those claims are built.

Liens and other claims against a settlement

Keep records of where the money is deposited, transferred, and spent.

Medical bills can add another layer. Where Medicare paid some of those bills, the Centers for Medicare & Medicaid Services explains how its recovery claims work.

A divorce question is a family law question. Raise it with a lawyer who handles divorce, alongside any injury claim.

Time limits and the basics of proving fault

Georgia generally gives two years to file a personal injury lawsuit. The clock starts when the right of action accrues. Missing that window can bar the claim, under O.C.G.A. § 9-3-33.

To win a negligence claim, the injured person generally has to show that someone owed a legal duty, broke it, and caused damage. Georgia law allows an injured person to recover damages for breach of a legal duty that causes injury, as set out in O.C.G.A. § 51-1-6.

Negligence means the absence of ordinary care. Georgia defines ordinary diligence as the care an ordinarily prudent person would use under the same or similar circumstances. See O.C.G.A. § 51-1-2.

Georgia also reduces recovery by the injured person’s share of fault. Under O.C.G.A. § 51-12-33, a plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages.

In a truck crash, records can matter. Federal rules require motor carriers to keep inspection, repair and maintenance records for 1 year. They must also keep them for 6 months after a vehicle leaves their control, under 49 C.F.R. § 396.3. Those records can help show what happened.

How settlements are reached and what expenses may apply

Most claims start with the insurance company. The usual path runs from a claim, to a demand, to negotiation, and then to either a settlement or a lawsuit. Each step can take time, and each offer deserves a careful look.

Claimants should not rush to accept an offer. You can negotiate with the insurer. See Georgia insurance claim tips.

Some injured people receive treatment under a provider lien. That lien defers payment until the claim is settled or resolved. Liens may be resolved from the settlement, so they can affect what the family keeps. Research on these arrangements is in the medical lien study.

We handle personal injury cases on a no-fee-unless-we-win basis, but you may still be responsible for court costs and case expenses.

Talk through your spouse’s situation with Terance Madden

If your spouse was hurt, you may be juggling hospital visits, missed paychecks, and an insurance letter all at once.
