Why Semi-Truck Crashes in Clayton County Differ From Ordinary Car Wrecks<\/h2>\n

Semi-trucks are much heavier than passenger cars, and they need far more distance to stop. Because of that size gap, injuries in truck crashes can be severe. Damage to a smaller vehicle can be extreme too.<\/p>\n

Heavy freight moves on the interstates and state routes that cross Clayton County. Interstate 75 and Interstate 675 carry commercial traffic near neighborhoods, schools and shopping areas in the south metro area. A crash on those roads can put a loaded truck in the middle of everyday traffic.<\/p>\n

Federal trucking rules set standards for how carriers run their trucks. Under section 395.8<\/a>, a motor carrier subject to the requirements of this part must require each driver used by the motor carrier to record the driver’s duty status for each 24-hour period. Under section 391.51<\/a>, each motor carrier must maintain a driver qualification file for each driver it employs, and each driver’s qualification file must be retained for as long as the driver is employed by that motor carrier and for three years thereafter.<\/p>\n

These records matter after a crash. Logs can show how long a driver had been working. Maintenance records can show whether the truck was kept in safe condition. Under section 396.3<\/a>, the records required by that section must be retained where the vehicle is either housed or maintained for a period of 1 year and for 6 months after the motor vehicle leaves the motor carrier’s control.<\/p>\n

Who Can Be Held Liable in a Jonesboro Truck Accident Case<\/h2>\n

Several parties can share responsibility for a truck crash, not only the driver. The driver, the motor carrier, the truck’s owner, a maintenance contractor, a cargo loader and a parts maker can each play a role. Who is responsible depends on the facts of your crash.<\/p>\n

Georgia divides fault among the people who contributed to an injury. Under O.C.G.A. \u00a7 51-12-33<\/a>, a defendant who gives the notice the statute requires may ask the jury to consider the fault of a nonparty, even someone never named in the lawsuit. If you are 50 percent or more responsible, you recover nothing. Under O.C.G.A. \u00a7 51-12-33<\/a>, where the plaintiff is to some degree responsible for the injury or damages claimed, the judge reduces the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault. That is why an early look at what happened matters so much.<\/p>\n

Georgia Deadlines and Evidence to Preserve After a Jonesboro Truck Wreck<\/h2>\n

Georgia generally gives two years to bring an injury lawsuit. Under O.C.G.A. \u00a7 9-3-33<\/a>, actions for injuries to the person must be brought within two years after the right of action accrues. If that test doesn’t happen within two hours, the employer must record why.<\/p>\n

A written request to preserve evidence, sent early to the carrier and its insurer, asks them to keep these records. You can help by keeping photos, the police report number, medical records, pay stubs or lost-wage records, and a daily journal of symptoms.<\/p>\n

What Affects the Value of a Semi-Truck Settlement?<\/h2>\n

There is no reliable average that fits every semi-truck case. Any published number should not be read as a prediction for your claim.<\/p>\n

Several factors shape value. These include how serious and lasting the injuries are, the medical treatment needed and its cost, lost income and reduced ability to earn, property damage, how strong the liability evidence is, and how many responsible parties and insurance policies are involved.<\/p>\n

Medical bills get special treatment. Under O.C.G.A. \u00a7 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care, treatment or services, as the trier of fact decides.
