You generally pursue missed pay as part of an injury claim against the people responsible for the crash. Your claim is supported by pay records, employer records, and medical notes that tie your missed work to your injuries. This guide explains what counts, how wages are proven and calculated, and the Georgia rules that shape the claim. T. Madden & Associates, P.C. has been in practice since 1999.

What Counts as Lost Wages After a Georgia Truck Wreck?

Lost wages are the pay you miss because of injuries from the crash. Georgia calls losses like this special damages. The law says these losses “actually flow from a tortious act” and “must be proved in order to be recovered” (O.C.G.A. § 51-12-2). In plain terms, you need records to show the loss.

Past lost wages run from the crash date until you return to work. They can include scheduled shifts, overtime you would have worked, and sick or paid time off you had to use. Unpaid time off, reduced hours, and lost commissions or bonuses can count too, when you can document them.

Future lost earning capacity is different. It covers a reduced ability to earn over time when injuries limit the work you can do. We cover it in a later section.

Lost wages are economic damages. They are separate from pain and suffering, which is a non-economic harm. Keep the two apart when you think about your claim, because each is proved in its own way.

If a truck crash has kept you off the job and the bills keep coming, our team can talk through your missed pay in a free, confidential first consultation. In a truck case, that often means the driver, the trucking company, and the insurer behind them. Georgia law makes a person liable for torts committed by a servant within the scope of his business, whether by negligence or voluntarily (O.C.G.A. § 51-2-2).

More than one party can be involved. A freight broker or the owner of the truck may also be part of the claim, depending on the facts.

If you were working when you were hurt, workers’ compensation may provide wage benefits. That claim runs on a separate track. Georgia’s workers’ compensation law generally makes those benefits your remedy against your employer.

The other driver’s insurer may make an early offer. Read any offer closely. Accepting one can limit what you can pursue later.

How Do You Prove Lost Wages After a Truck Crash?

You prove lost wages with pay records, employer records, and medical notes. Those records should show what you earned before the crash and what you missed after it. Start with the paperwork you already have. Recent pay stubs, W-2 forms, and federal tax returns show your normal earnings.

Next, ask your employer for records of your hours, schedule, and time off. Many employers complete a wage verification form. The form usually states your pay rate, your schedule, the hours you missed, and any lost benefits.

Medical proof matters too. Treatment records and doctor’s notes should connect your injuries to missed work. They should also list any work restrictions, such as lifting limits or a ban on driving for pay.

Consistency helps. Keep a steady record of missed days, appointments, and light-duty limits. A record that matches the medical notes is easier to follow than one that changes. Keep the originals, and never throw out papers, even ones that seem small.

How Is the Amount of Lost Wages Calculated?

The basic math is your pay rate multiplied by the hours you would have worked during the missed period. An hourly worker uses timesheets and pay stubs. A salaried worker uses the salary for the days missed. Regular overtime is added when it’s documented.

Commission workers can show sales reports and pay statements. Tipped workers may need tip reports or deposit history. Each type of pay needs its own proof.

Self-employed and gig workers use other records. Invoices, bank deposits, and tax schedules show income before and after the crash. These records show how much work came in, not only what was billed.

Compare earnings before and after the crash. If your pay dropped, explain the gap with the records behind it. An unexplained gap invites questions from the insurer.

Future earnings are discounted. Georgia law lets the judge or jury reduce future economic losses to present value, using a 5 percent discount rate or another rate it finds appropriate (O.C.G.A. § 51-12-13). That is why a future figure can be lower than a simple salary multiplied by years.

When Injuries Affect Future Earnings

When an injury limits the type or amount of work you can do over the long term, future lost earning capacity may be part of your claim. Whether it applies depends on the facts of your injury, your age, and your career path.

Proof of this loss is different from proof of past wages. It usually needs medical opinions on permanent restrictions. Vocational information about the work you can still do also helps. Your work history before the crash shows what you were earning and doing.

Severe injuries often bring this claim. Spinal cord damage, traumatic brain injury, and amputation are common examples. The Georgia Department of Public Health states that traumatic brain injuries carry substantial economic costs.

These cases need detailed documentation from the start. Waiting until the case is in court to gather medical and work records makes the claim harder to build.

Why Truck Accident Wage Claims Can Be More Complex

Truck cases often involve more parties and more records than car cases. The driver, the motor carrier, and sometimes a broker may each carry separate insurance and keep separate records. Those records can help show how the crash happened and who is responsible.

Federal rules govern many of these records. Motor carriers subject to the federal rules must require each driver to record their duty status for each 24-hour period, except private motor carriers of passengers (nonbusiness). A motor carrier must keep those records and supporting documents for not less than 6 months from the date of receipt (49 C.F.R. § 395.8). The same rule says no driver or motor carrier may make a false report in connection with a duty status.

Georgia’s Department of Public Safety summarizes the federal hours-of-service limits for commercial drivers, including driving, on-duty, and restart rules (Georgia DPS hours-of-service rules).

Two practical points follow. First, the trucking company holds most of these records, and you may need a formal request to obtain them. Second, the six-month retention minimum is a reason to act early. The number of parties and the size of the company’s insurance can also change how a wage claim is handled.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Georgia Fault Rules and Deadlines That Affect Your Wage Claim

Georgia reduces your damages by your share of fault. It bars recovery if you are 50 percent or more responsible. Georgia calls this modified comparative fault, or shared fault. The judge reduces the damages in proportion to your percentage of fault (O.C.G.A. § 51-12-33). If you are 50 percent or more responsible, you cannot receive any damages under the same statute.

The standard deadline for an action for injuries to the person is two years after the right of action accrues (O.C.G.A. § 9-3-33). A spouse’s loss of consortium claim has four years under the same section. Other rules can change timing, so check the date early.

Claims against government bodies follow different clocks. A claim against a city must be presented in writing to its governing authority within six months of the event, stating the time, place, and extent of the injury and the specific amount of monetary damages being sought (O.C.G.A. § 36-33-5). Claims against counties must be presented within 12 months after they accrue or become payable or they are barred (O.C.G.A. § 36-11-1); minors and others under a disability get 12 months after the disability is removed.

Punitive damages are a separate matter. Georgia allows them only when clear and convincing evidence shows willful misconduct, malice, fraud, wantonness, oppression, or conscious indifference to consequences (O.C.G.A. § 51-12-5.1). They punish a defendant. They are not a payment for your wages.

What to Keep and What to Avoid Saying While You Recover

Keep every record that shows what you earned and what you missed. Pay stubs, work schedules, sick and paid time off records, appointment dates, doctor’s work notes, and receipts for out-of-pocket costs all count. Store copies in one place, and keep the originals.

Keep a simple daily log. Write down symptoms, missed shifts, and tasks you can no longer do. A short entry each day is easier to prove later than a memory pieced together months afterward.

Insurers often ask for a recorded statement early. Gather your records before you give one. Don’t guess at dates, dollar amounts, or hours missed. Say “I don’t know” when that is the true answer, and say you will check your records.

Medicare can also change the math.

Talk With T.
