Georgia calls this presenting the claim. Under O.C.G.A. § 36-11-1, all claims against counties must be presented within 12 months after they accrue or become payable, or they are barred; minors and persons under other disabilities get 12 months after the disability is removed. That is much shorter than the two-year period that covers most injury claims.

A crash with a truck can involve only a private company, only a county, or both. Because the window is short, the first question is whether a county is a possible defendant at all.

Many people hear “two years” and assume they have time. For a county claim, the 12-month window can close while you’re focused on medical care, insurance calls and repairs. That’s why the question belongs early in your timeline.

If a county might be part of your Clayton County truck crash, our team can talk through what the deadlines mean for you. Ask yourself who owned the truck, who was driving, and who was responsible for the road.

Under O.C.G.A. § 51-2-2, a person is liable for torts a servant commits by command or within the scope of that person’s business. O.C.G.A. § 51-2-2 makes “every person” liable for torts committed by his servant by his command or within the scope of his business, but the statute does not by its terms address whether or how a county is liable.

A truck owned by a private trucking company works differently. A claim against that company generally falls under the two-year injury deadline in O.C.G.A. § 9-3-33. Both clocks can run at once in one crash, which is why sorting out the county question early matters.

How Long Do You Have to Present a County Claim?

You have 12 months after the claim accrues or becomes payable, under O.C.G.A. § 36-11-1. Those legal terms set the start date. The statute also gives minors and people under other disabilities 12 months after the disability is removed.

Your two-year deadline for injuries to the person is a separate clock under O.C.G.A. § 9-3-33.

A common mistake is assuming the two-year rule controls everything. For a county, the shorter 12-month window controls. Write down the crash date and the date of every county letter you receive. Those dates are the anchors for each clock.

How Georgia’s Fault Rules Affect a Truck Crash Claim

Georgia reduces your damages by your share of fault. If you are 50 percent or more responsible, you recover nothing. Under O.C.G.A. § 51-12-33, where the plaintiff is to some degree responsible for the injury or damages claimed, the judge shall reduce the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible.

Truck crashes often raise fault questions about the driver, the trucking company and sometimes the road itself. Each party may point toward another. If you’re helping an injured family member, the same rules apply to their claim. Write down what you remember while the details are fresh, and keep photos and bills that show the injuries and when they began.

A Notice Is Not a Lawsuit: What Comes Next

Presenting a claim to a county is a step before a lawsuit, not the lawsuit itself. The 12-month rule sets the deadline for presenting the claim. A court case comes after that and follows its own filing rules.

If the defendant is a trucking company, Georgia law sets specific conditions for when its insurer can be named as a party, and those conditions have exceptions. Under O.C.G.A. § 40-1-112(c)(1), a person with a cause of action arising under that part may join the motor carrier and the insurance carrier in the same action only when one or more related motor carriers are insolvent or bankrupt, or when personal service, as provided in subsection (e) of Code Section 9-11-4, cannot after reasonable diligence be effected (i) against the driver of the vehicle of the motor carrier giving rise to the cause of action or (ii) against the motor carrier.

Many parties can be tied to one truck crash. Keep track of who the driver worked for, who owned the truck and who insured it. Each answer affects who can be named in a claim.

Evidence to Protect While the Clocks Run

Start preserving evidence early, because trucking records have set retention periods. Motor carriers must keep driver records of duty status (logs of hours on the road) for at least six months from receipt, under 49 C.F.R. § 395.8. Under 49 C.F.R. § 379.3, companies subject to this part shall retain records for the minimum retention periods provided in appendix A to this part. After the required retention periods, the records may be destroyed at the discretion of each company’s management. It shall be the obligation of the subject company to maintain records that adequately support financial and operational data required by the Secretary. The company may request a ruling from the Secretary on the retention of any record. The provisions of this part shall not be construed as excusing compliance with the lawful requirements of any other governmental body prescribing longer retention periods for any category of records.

A preservation letter can be short. Name the crash date, the driver and the truck, and ask the company to keep its logs and related records. Send it in writing and keep a copy.

Other evidence to protect includes the crash report, photos of the scene and both vehicles, witness names and phone numbers, medical records and bills, and photos of any road defect you noticed. Keep the damaged vehicle or its parts if you can, and photograph it before any repair.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Questions About Notice, Lawsuits and Cost

Here are short answers to common questions about notice, lawsuits and cost.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do I have to give notice before suing a county after a truck crash in Georgia?

Yes, when a county may be a defendant, the claim must be presented within 12 months after it accrues or becomes payable, but minors or other persons laboring under disabilities are allowed 12 months after the removal of the disability.
