In Georgia, the injured person brings the claim, but punitive damages are available only when the defendant’s conduct meets a high legal standard. They are not meant to repay your losses. They exist to punish, penalize, or deter a defendant. Georgia’s rules appear in O.C.G.A. § 51-12-5.1. This page explains who can seek them, what conduct qualifies, and how they are limited.

Who can receive punitive damages in Georgia?

The injured person can ask for punitive damages, but only against a defendant whose conduct meets the statute’s standard. The request must be made in the complaint, the document that starts the lawsuit. The statute says these damages are awarded “not as compensation to a plaintiff but solely to punish, penalize, or deter a defendant.”

That is the key difference from compensatory damages. Compensatory damages pay for the harm you suffered. Georgia law provides that punitive damages are awarded not as compensation to a plaintiff but solely to punish, penalize, or deter a defendant.

If a truck crash changed your life or your family's, we are glad to talk through your situation with you, at your own pace. The statute lists willful misconduct, malice, fraud, wantonness, oppression, or “that entire want of care which would raise the presumption of conscious indifference to consequences.”

Terms such as willful misconduct are often discussed in injury cases, and how they apply can depend on the facts of a particular case. The term wantonness is also discussed in injury claims, and how it applies can depend on the facts of a particular case. Phrases like conscious indifference are sometimes discussed in injury claims, and how they apply depends on the facts of each case.

Ordinary negligence is different. O.C.G.A. § 51-12-5.1 does not define ordinary diligence; it provides that punitive damages may be awarded only in such tort actions in which it is proven by clear and convincing evidence that the defendant’s actions showed willful misconduct, malice, fraud, wantonness, oppression, or that entire want of care which would raise the presumption of conscious indifference to consequences. A simple mistake at an intersection is usually ordinary negligence, and that alone does not meet the higher standard.

In truck cases, courts may examine conduct such as:

Alcohol use. 49 C.F.R. § 392.5 bars drivers from using alcohol or being under its influence within 4 hours before going on duty or operating, or having physical control of, a commercial motor vehicle.

False logs. 49 C.F.R. § 395.8 says no driver or motor carrier may make a false report in connection with a duty status.

Skipped maintenance. 49 C.F.R. § 396.3 requires carriers to keep vehicle parts in safe and proper operating condition at all times.

These rules show what a court may review. They do not predict how any case will turn out.

Can the driver, the trucking company, or both be liable for punitive damages?

Punitive damages can be sought against any defendant whose own conduct meets the standard. That can include the driver. It can also include the trucking company, depending on what the company did or failed to do.

Federal rules place duties on carriers. A carrier must investigate each driver’s safety performance history with past DOT-regulated employers for the preceding three years. A carrier also may not make a fraudulent or intentionally false statement on a required record, as 49 C.F.R. § 390.35 explains.

A company’s decisions about who drives for it, and how it checks them, can be part of a case. Each defendant’s conduct is reviewed on its own facts. A finding against one party does not automatically decide the claim against another.

Is it hard to prove punitive damages, and what is the burden of proof?

That is a demanding standard of proof, and the injured person must meet it.

The process also has steps. Under O.C.G.A. § 51-12-5.1, the jury first decides from the evidence whether punitive damages will be awarded, using a special verdict form. If it finds they will, the trial restarts to hear evidence on the amount needed to deter, penalize, or punish the defendant.

In truck cases, the proof often comes from crash reports, driver logs, maintenance and inspection records, and witness testimony. Federal hours-of-service rules cover driving limits, rest breaks, and sleeper-berth provisions, so records about them can matter. Whether this evidence supports a punitive claim depends on the facts.

Why do judges reduce or limit punitive damages?

For tort actions not provided for by subsection (e) or (f) of Georgia’s punitive damages statute, the amount of punitive damages is limited to a maximum of $250,000.00. That cap is written into the statute, so it sets a clear ceiling for many claims.

The statute has exceptions. There is no fixed limit when a defendant acted with specific intent to cause harm, but only in a tort case not arising from product liability, and only against an active tort-feasor; such damages are not the liability of any other defendant. There is also no fixed limit when a defendant acted while under the influence of alcohol, drugs other than lawfully prescribed ones used as prescribed, or any intentionally consumed glue, aerosol, or other toxic vapor, to a degree that substantially impaired judgment, but only against an active tort-feasor. In those cases, damages fall only on an “active tort-feasor,” meaning the party who actively committed the wrong.

The statute treats product liability cases under separate rules. How the law applies depends on the facts of each particular case.

What to do if you’re asking this question about your own crash

If a truck crash hurt you or someone you love, you may be asking this question while still recovering. You may also be dealing with a family member’s death and a long list of hard decisions.

You don’t have to sort out the law alone.
