Usually less than the number in the offer. A $25,000 settlement is typically the gross total, before the attorney fee, case expenses, medical bills and liens are paid. What you keep is the net amount.

Many people asking this question are still hurting from a car or truck crash. Some are missing work. Others are a spouse or adult child trying to help a family member decide. An insurer’s letter can feel urgent, even when the numbers aren’t clear yet.

This page explains the gap between the gross figure and your net. It walks through a labeled hypothetical example. It ends with questions to ask before you accept any offer. For the broader picture, read our Georgia car accident lawyer guide.

What a Settlement Figure Is Meant to Cover

A settlement is meant to pay for the losses a crash caused. That includes bills you can add up and harms that are harder to count.

Economic losses are money losses you can document. These include medical care, lost wages and property damage, such as a totaled car. Georgia law treats these as special damages that must be proved, under O.C.G.A. § 51-12-2. Necessary expenses from an injury are also a legitimate part of the damages estimate, under O.C.G.A. § 51-12-7.

Non-economic losses cover pain, emotional distress and loss of enjoyment. Georgia law leaves the value of purely emotional harm to “the enlightened consciences of impartial jurors,” under O.C.G.A. § 51-12-6.

Two $25,000 offers can cover very different losses. One may count only bills to date. Another may include treatment still ahead and time away from work. Ask which losses the number includes. Our damages guide explains each category.

What Typically Comes Out of a Settlement

Several amounts can come out of a settlement before you receive the rest. These usually include the attorney fee, case expenses, medical bills or liens, and any other amount owed from the money.

The attorney fee is set by the written agreement you sign with your lawyer. Read how it’s calculated and what it covers before you sign. Case expenses are the costs of building the claim, such as medical records, reports and investigation.

Medical bills and liens are claims by others against the recovery. A lien is a legal claim a provider or payer can hold until it’s paid or resolved. The next section covers these in more detail.

The net is what remains after every deduction. It is often much smaller than the gross figure. Before you sign a release, ask for an itemized list of every deduction. A release generally ends the claim, so get the numbers in writing first.

Medical Bills, Health Insurers and Liens in Georgia

Medical providers, health insurers and government programs can all hold a claim against your recovery. Those claims should be identified before any money goes out.

Georgia law limits medical damages to the reasonable value of medically necessary care. That rule appears in O.C.G.A. § 51-12-1.1. The billed number is not always the number that matters.

Some treatment is given under a letter of protection, which is a promise to pay the provider from your settlement. The same statute says that in a claim for medical and healthcare expenses rendered under a letter of protection or similar arrangement, the letter, the itemized charges and the referral source are relevant and discoverable, and so is the third party’s name and purchase price if the provider sells the bill to a third party at less than the invoice price.

Medicare is a separate issue.

A lawyer may be able to talk with providers and lienholders about reducing these amounts. No reduction is promised, and results differ from claim to claim.

Example: How a Hypothetical $25,000 Settlement Could Be Split

In this hypothetical example, a $25,000 settlement leaves $12,050 after fee, costs and bills. A second version of the same settlement leaves far less. This is an illustration, not a prediction of any real case or of this firm’s results.

Step

Scenario A

Scenario B

Gross settlement

$25,000

$25,000

Attorney fee (hypothetical, per written agreement)

−$8,000

−$8,000

Case expenses (hypothetical)

−$750

−$750

Medical bills and liens (hypothetical)

−$4,200

−$14,000

Net to client

$12,050

$2,250

Both rows use the same gross figure. The difference comes from the bills and liens. How much those claims take depends on the facts of each claim.

Notice what the example shows. A bigger bill can cut the net far more than the fee does. That is why you should ask about liens before you accept anything.

Why Lawyers Take a Share and How the Fee Works

A lawyer’s fee is a share of the recovery, set out in a written agreement. It pays for the work of pursuing the claim.

T. Madden & Associates, P.C. handles personal injury claims on a no-fee-unless-we-win basis, but the client may still be responsible for court costs and case expenses. The firm has practiced personal injury law since 1999.

That share covers real work. It includes time spent on investigation, gathering records, negotiating with insurers and, if needed, litigation. Each of those steps takes time and costs money.

Read the fee terms before you sign. Ask how the percentage is applied, and whether it’s calculated before or after case expenses. The written agreement should answer both questions.

The firm’s first consultation is free, confidential and carries no obligation to continue.

Questions to Ask Before Accepting a Settlement Offer

Before you accept an offer, ask whether it covers future care, which liens are open, and what your net will be. Georgia’s deadlines and fault rules matter too.

Does the offer cover future medical care you know about, or only bills to date?

Which providers, insurers or government programs have a lien or reimbursement claim, and in what amounts?

What will the net be after the fee, case expenses and liens, and is that figure in writing?

Georgia generally requires a personal injury action to be brought within two years after the right of action accrues, under O.C.G.A. § 9-3-33. Signing a release can end the claim, so check the timing first.

Georgia reduces an award by the injured person’s share of fault. Under O.C.G.A. § 51-12-33, a plaintiff who is 50 percent or more responsible cannot receive damages.

Also ask the insurer to explain how it reached the number. A written explanation helps you compare it with the losses on this list.

Talk Through Your Offer Before You Sign

If an offer is on the table, you can talk it through with our team before you decide.
