T. Madden & Associates, P.C. is a Georgia personal injury firm that has practiced since 1999. A delivery truck accident lawyer in Atlanta, GA can help you sort out those questions. This page offers general information about personal injury claims in Georgia.

What a Delivery Truck Accident Case Covers and Who It Is For

A delivery truck accident case covers injuries or deaths caused by a delivery vehicle on Atlanta-area roads. That includes delivery vans, box trucks, cargo vans and last-mile delivery vehicles that drop off packages at homes and businesses.

Many people think only big rigs count. Delivery vehicles are smaller, but they share busy roads with cars, motorcycles and bikes. Their routes often include many stops in one day, and that schedule can shape how a driver moves through traffic.

This page is for injured drivers, passengers, pedestrians and cyclists. It also helps families who lost someone in a crash.

Terance Madden leads the firm. The firm’s lawyers include Terance Madden and Shenia Madden, supported by assistants and office staff. Offices are in Jonesboro (Clayton County), Atlanta, Decatur, Macon and Augusta. In practice, the key questions are who set the route and schedule and who could direct the work.

Parts and repair companies. Brake, tire or equipment failures can point to maintenance contractors or manufacturers.

Which insurance applies turns on who was driving, for whom, and at what time.

What Compensation Can Include in a Delivery Truck Claim

A claim can seek money for medical bills, lost income, vehicle damage and pain and suffering. General damages are presumed to flow from the wrong and can be recovered without proof of an amount. Special damages actually flow from the wrong and must be proved (O.C.G.A. § 51-12-2). Medical bills and lost pay are common special damages, so keep every receipt and pay record.

Medical bills, past and future care, rehabilitation and medication

Lost wages and reduced ability to earn

Vehicle repair or replacement

Pain, suffering and loss of enjoyment of life

For a wrongful death, the personal representative of the deceased may recover funeral, medical and other necessary expenses when death results from a crime or from criminal or other negligence (O.C.G.A. § 51-4-5)

Medicare may pay accident bills first. Plan for that early.

Evidence That Is Often Lost Early in a Delivery Truck Crash

The most useful proof is often the proof that disappears first: video, GPS data, app records and vehicle files.

Dash cam video, GPS and telematics, and delivery app timestamps, which can show speed, stops and timing

Driver logs, hours, training records and past safety complaints

Vehicle inspection, maintenance and repair records

Photos, the police report, witness contact details and medical records

Federal rules also set a clock for testing. For commercial motor vehicles, the employer must test surviving drivers after certain crashes. Under 49 CFR 382.303, after an accident involving a commercial motor vehicle on a public road, an employer must test for alcohol each surviving driver who was performing safety-sensitive functions with respect to the vehicle if the accident involved the loss of human life, or each surviving driver who receives a citation within 8 hours of the occurrence under State or local law for a moving traffic violation arising from the accident, if the accident involved bodily injury to a person who immediately receives medical treatment away from the scene, or one or more vehicles incurring disabling damage that requires a tow truck or other motor vehicle to transport it away from the scene. Alcohol tests are due as soon as practicable following the accident, and if one is not administered within two hours, the employer must keep a record of why. If one is not given, the employer must keep a record of why. Under 49 C.F.R. § 382.303, if an alcohol test is not administered within eight hours following the accident, the employer shall cease attempts to administer an alcohol test, and if a controlled substances test is not administered within 32 hours following the accident, the employer shall cease attempts to administer a controlled substances test.

Early written requests matter, because routine systems can overwrite data. Ask for preservation as soon as you can.

Georgia Deadlines and Fault Rules That Shape Your Claim

Georgia generally requires injury lawsuits to be filed within two years after the right of action accrues. O.C.G.A. § 9-3-33 sets that rule for injuries to the person. The statute has exceptions, and the start date turns on the facts of each case.

Georgia also reduces damages when the injured person shares fault. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to your percentage of fault. If you are 50 percent or more responsible, you cannot recover damages. Insurers may argue that you share the blame, so early evidence helps answer that point.

Federal hours rules may also matter. Under the federal driving-hours rule, a driver may not drive without first taking 10 consecutive hours off duty. A driver also may not drive after 14 consecutive hours following that break. These rules cover property-carrying commercial motor vehicles, so whether they apply depends on the vehicle and the trip.

What Happens After You Contact T. Madden & Associates, P.C.

Your case starts with a free first consultation, where the firm reviews the crash, your injuries and your paperwork. Under 49 C.F.R. § 382.303, after a crash involving a commercial motor vehicle in which someone was injured and immediately treated away from the scene, or a vehicle had disabling damage requiring a tow away, an employer tests a surviving driver for alcohol if that driver receives a citation within 8 hours for a moving traffic violation arising from the crash, and tests for controlled substances if the citation is received within thirty-two hours. Whether a given van or truck falls under those rules depends on the vehicle. If a delivery van or box truck just hurt you or someone you love near Atlanta or Clayton County, and an insurance adjuster is already calling, you do not have to sort out fault alone.
