Georgia sets that two-year limit for injuries to the person under O.C.G.A. § 9-3-33. Other claims can have shorter or longer clocks, and a few rules can pause the clock. This page explains the main deadlines. It is written for injured riders and for family members helping someone who was hurt. T. Madden & Associates, P.C. has practiced personal injury law since 1999 and represents people hurt in e-bike crashes.

The Short Answer: Two Years for Most Georgia E-Bike Injury Claims

Most injury lawsuits in Georgia must be brought within two-year deadline for injury lawsuits. The statute says actions for injuries to the person “quoted statute languageshall be brought within two years after the right of action accrues.” That rule generally covers a rider or passenger hurt in a crash with a car, a truck or another party.

This is a deadline for filing a lawsuit. It is not a deadline for an insurance claim. Insurance negotiations can take time, so it can help to speak with a lawyer early in the process. A common mistake is waiting for an insurer’s answer before checking the calendar. The two-year period is counted forward from that date.

Here is a simple example. A rider is hurt on June 3, 2027. Counting two years forward points to June 3, 2029. Calendar dates matter, so the crash date is the first fact to lock down.

Write down the date, the time and the exact location as soon as you can. Note the names of any witnesses and the police report number if one was filed. Save photos of the scene, the bike and your injuries. Do not wait until treatment ends to start thinking about the calendar. Every other deadline in this guide depends on that crash date.

Wrongful Death Deadlines After a Fatal E-Bike Crash

When an e-bike crash causes a death, Georgia law says who may bring the claim. A surviving spouse may recover for the homicide of a spouse or parent. If there is no surviving spouse, a child or children may do so. The recovery is “the full value of the life of the decedent, as shown by the evidence” under O.C.G.A. § 51-4-2.

If no one is entitled to bring the action, the administrator or executor may bring it for the next of kin, under O.C.G.A. § 51-4-5. That same section allows the personal representative to recover funeral, medical and other necessary expenses resulting from the injury and death when the death results from a crime or from criminal or other negligence, under O.C.G.A. § 51-4-5.

A spouse’s loss of consortium claim arising from an injury has four years under O.C.G.A. § 9-3-33. Families should not wait on a criminal case, an insurance review or a settlement offer before checking the filing date. None of those steps is the filing deadline itself.

Georgia’s Time Limit for Personal Injury Claims

Under O.C.G.A. § 9-3-33, except as otherwise provided, actions for injuries to the person must be brought within two years after the right of action accrues, while the statute’s four-year period applies to actions for injuries to the person involving loss of consortium. The injury claim stays on the two-year track under § 9-3-33.

Keep the damaged bike and parts until the claim is resolved. Save repair estimates, receipts and photos. Those records show what was lost and what it cost to replace or repair.

Exceptions That Can Change the Deadline

Several rules can change the timing. Which one applies depends on who was hurt, who caused the crash and where it happened.

Minors. Under O.C.G.A. § 9-3-90, except as otherwise provided in Code Section 9-3-33.1, a person under 18 when the claim arises gets the same time to sue as others, counted from age 18. Parents should still act early, because these rules can be complicated.

Cities, counties and the state. If a government entity owns the road or caused the hazard, different notice rules apply. For a city, O.C.G.A. § 36-33-5 requires a written claim to the governing authority within six months of the event. For a county, O.C.G.A. § 36-11-1 requires claims to be presented within 12 months after they accrue or become payable, or they are barred, provided that minors or other persons laboring under disabilities shall be allowed 12 months after the removal of the disability to present their claims. For the state, O.C.G.A. § 50-21-26 requires written notice within 12 months of when the loss was discovered or should have been discovered.

Criminal cases. Under O.C.G.A. § 9-3-99, the time for a crime victim to file a tort claim arising from a crime committed in Georgia is tolled from the date of the alleged crime until the prosecution becomes final or otherwise ends. That tolling cannot exceed six years, so it should not be counted on.

Why an Open Insurance Claim Does Not Stop the Filing Deadline

Talking with an insurance adjuster is not the same as filing a lawsuit. The two-year period in O.C.G.A. § 9-3-33 is set by statute. A lawsuit must be brought within two years after the right of action accrues, so a claim generally cannot stay open once that time runs out.

An offer may arrive before or after the deadline. Read any offer carefully before you accept it or sign a release. Ask how it affects your claim and your time to sue.

Auto policies in Georgia carry their own terms. Under O.C.G.A. § 33-7-11(g), an uninsured motorist endorsement cannot stop the insured from employing legal counsel or instituting legal proceedings. O.C.G.A. § 33-7-11 reads: “(g) No endorsement or provisions shall contain a provision requiring arbitration of any claim arising under any endorsement or provisions, nor may anything be required of the insured, subject to the other provisions of the policy or contract, except the establishment of legal liability; nor shall the insured be restricted or prevented, in any manner, from employing legal counsel or instituting legal proceedings.”

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Frequently Asked Questions About E-Bike Deadlines in Georgia
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do I have to sue after an e-bike crash in Georgia?

Most injury claims must be brought within two years after the right of action accrues, under O.C.G.A. § 9-3-33.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is there a deadline to sue a hit-and-run driver?

The answer depends on the facts, including whether the driver is identified and what insurance applies.
