It explains the Georgia Code sections that matter most after an injury, including fault, filing deadlines and tolling.

T. Madden & Associates, P.C. is a Georgia personal injury firm in practice since 1999, with offices in Jonesboro, Atlanta, Decatur, Macon and Augusta. Terance Madden is the responsible lawyer for this page. Our team takes e-bike accident claims with no attorney fee unless we recover compensation for the client, though the client may still be responsible for court costs and case expenses.

Georgia e-bike laws at a glance

Many people first see an e-bike rule online and assume it applies everywhere. That is a common mistake. A rule that fits one city may not fit a county trail a few miles away.

The rules matter most when something goes wrong. A crash can lead to questions about who was at fault, how much a claim is worth, and when a lawsuit must be filed. Those questions are answered by the injury laws described below.

How Georgia defines an electric bicycle

The first question in any e-bike case is what kind of machine was involved. The type of vehicle affects which rules apply to the rider and to the other people on the road.

Electric bikes can look like bicycles, scooters or motorcycles to the untrained eye. A device with a motor may be treated differently from a pedal bike under the traffic code. Riders should not assume the label on a store display settles the question.

Classification matters in a claim, too. The facts of the device and how it was used both count.

Speed, motor type and where you can ride

Riders who use the same route every day should know the rules where they ride.

If a crash happens on a city-owned road, Georgia has an extra step. Under O.C.G.A. § 36-33-5, a claim for money damages against a city on account of injuries to person or property must be presented in writing to the city’s governing authority within six months of the event. Under O.C.G.A. § 36-33-5, a claim for money damages against a municipal corporation must be presented in writing to the governing authority within six months of the event, stating the time, place, and extent of the injury, as nearly as practicable, and the negligence which caused the injury. The description of the extent of the injury must include the specific amount of monetary damages being sought (O.C.G.A. § 36-33-5).

Helmet, age and parent responsibility

The helmet rule in Georgia’s code is written for motorcycles. Under O.C.G.A. § 40-6-315, no person shall operate or ride upon a motorcycle unless wearing protective headgear that meets state standards. The same section exempts riders in an enclosed cab or motorized cart.

That section is about motorcycles. It does not, by its own words, set a helmet rule for electric bikes. Riders who want to protect themselves should still wear a helmet, because head injuries can be serious.

Parents should know that Georgia law can reach a family beyond the rider. Under O.C.G.A. § 51-2-2, a person is liable for torts committed by his or her child when the child acts by the person’s command or in the prosecution and within the scope of the person’s business.

When an e-bike rule is broken and someone is hurt

Georgia uses fault rules that look at each person’s share of responsibility for the crash.

Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s percentage of fault. A plaintiff who is 50 percent or more responsible for the injury or damages may not receive any damages.

Georgia also has an avoidance rule. Under O.C.G.A. § 51-11-7, if the plaintiff by ordinary care could have avoided the consequences of the defendant’s negligence, the plaintiff is not entitled to recover. In other cases, the defendant is not relieved just because the plaintiff contributed in some way.

Timing is critical. Georgia generally requires a personal injury lawsuit to be filed within two years, under O.C.G.A. § 9-3-33, as quoted in a Georgia Court of Appeals decision.

Our team handles e-bike accident claims on a no-fee-unless-we-win basis. You may still be responsible for court costs and case expenses.

Employers, delivery riders and duty of care

A rider who works for a company may raise a different question. Under O.C.G.A. § 51-2-2, a person is liable for torts committed by a servant in the prosecution and within the scope of the person’s business. That rule can matter when a delivery rider is hurt or causes a crash on the job.

Georgia also recognizes a duty to avoid harming others. Under O.C.G.A. § 51-1-6, an injured party may recover for breach of a legal duty if the party suffers damage.
