A lien is a legal claim on the money you recover, and it is separate from the bill you owe. This page explains how these claims work, what gets checked before money is paid out, and how court costs fit in. T. Madden & Associates, P.C. has practiced since 1999.

What Is a Lien, and Why Can It Reach Your Settlement?

A lien is a legal claim against money you recover in a case. It is not the same as a medical bill. The bill is what you owe the provider. The lien is a claim on the settlement that pays for that care.

Catastrophic injuries often create large bills quickly. A spinal cord injury can cause paralysis. MedlinePlus explains that paralysis involves loss of muscle function and may be complete or partial. The World Health Organization notes that these injuries can cause substantial sensory, motor and functional impairments. Hospital stays, surgery, rehabilitation and equipment add up fast.

A hospital lien is one kind of claim. That question is separate from who the bill is owed to. So one set of bills can lead to more than one claim on the same settlement.

If a hospital bill or Medicare card is weighing on you while a settlement offer is pending, you do not have to sort out those liens alone; our team is ready to talk. Each lien document can use different wording and dates. We check the exact requirements against each lien document in your file, rather than assuming every lien is valid.

Timing is one of the first things we review on a claim, along with the dates of your care and discharge. Keep every lien notice you receive and write down the date and the provider’s name. Don’t sign a payoff letter until the lien has been reviewed.

How Do Medicare’s Recovery Rights Work After a Serious Injury?

Medicare can pay your bills while a claim is open. After a serious crash, many injured people use Medicare for the first time. They often don’t know its repayment rules.

Payments made during a case are often called conditional payments.

Medicare Advantage and other plan types can have their own recovery terms. That is why the plan type must be confirmed before anyone negotiates. Gather every Medicare notice you have received, since those letters help identify the payments.

Do Health Insurers and Other Payers Have Reimbursement Claims?

Yes, a private health plan that paid your bills may seek repayment from your settlement under its policy terms. Insurers call this subrogation. Subrogation is a payer’s right to recover what it paid from money the injured person later gets from the responsible party.

The plan document controls, not just the insurance card. A card shows the plan name and member number. It does not show the repayment terms. Employer plans can have terms that differ from Georgia’s hospital lien rules, so each plan needs its own review.

Medicaid is one example. List every payer from the start, including any program that paid even part of a bill.

Why Must Liens Be Resolved Before Settlement Money Is Paid Out?

In practice, settlement money is not fully paid out until each lien and reimbursement claim is identified and addressed. A missed payer can hold up the whole settlement. That is why the list must be complete.

The process usually starts with itemized bills from every provider. Ask each hospital, doctor and payer for a written lien or reimbursement statement. Then confirm each amount against the bills and the plan terms. If an amount is disputed, that part is usually held back until the dispute is resolved.

Medical expenses are special damages under O.C.G.A. § 51-12-1.1. Special damages must be proved before they are recovered, under O.C.G.A. § 51-12-2.

Why Are Lien Amounts Often Negotiated?

Lien amounts are often negotiated. The figure a provider or payer claims is not always the figure that must be repaid. Georgia’s medical expense rules help explain why the numbers can move.

Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. The trier of fact, such as a jury, decides that amount. If the plaintiff has any form of public or private health insurance, the evidence must include both the amount charged and the amount actually necessary to satisfy those charges under the insurance contract or the applicable program. If you have any form of public or private health insurance, evidence must include both the amount charged and the amount actually necessary to satisfy those charges under your insurance contract or the applicable governmental workers’ compensation program, whether or not the insurance was used. This applies whether or not the insurance was used.

The statute also changes the older collateral source rule, which keeps payments from other sources out of a damages case. It changes that rule only as far as needed to admit this evidence. The judge can give jury instructions about how insurance payments affect a recovery.

If a provider treated you under a letter of protection (a promise to be paid from your settlement), that letter can be requested in the case. So can the itemized and coded charges. So can any sale of the bill below invoice price. Either side can challenge whether charges are reasonable or whether treatment was medically necessary.

Outcomes depend on the facts of each claim, the payers involved and the documents. No one can predict them in advance.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Do Court Costs and Case Expenses Still Apply Under a Contingency Fee?

Yes, a contingency fee does not mean you owe nothing for the case. We work on a no-fee-unless-we-win basis, but you may still be responsible for court costs and case expenses, whether or not the case is won.

Case expenses can include records fees, medical record reviews, filing costs and similar charges. These affect the net amount you receive after liens are resolved.

Georgia law treats necessary expenses from an injury as a legitimate item in the damages estimate, under O.C.G.A. § 51-12-7. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault.
