It can be part of your claim, along with wages you already missed. This guide explains how the claim works, what drives its value, and how Georgia’s fault rule can change what you recover. T. Madden & Associates, P.C. has practiced since 1999.

What Is Loss of Earning Capacity?

Lost earning capacity is the reduction in your ability to earn income going forward. It looks ahead. It is different from income you already lost.

Picture a delivery driver with a spinal cord injury who can no longer lift, climb or sit through a full shift. That driver may face years of lower earnings, or none at all. The question is not only whether the driver has gone back to a job. It is what the driver can still do for pay.

Spinal cord injuries can cause serious harm. MedlinePlus paralysis guide explains that paralysis involves loss of muscle function and may be complete or partial.

Because the claim is about capacity to work, a return to work does not settle the question on its own. You and the people who handle your case will look at what your body can handle now and over the years ahead.

If a serious crash has kept you from full-time work, you may have a claim for future income, and you don't have to work through it alone. Lost earning capacity covers the years ahead.

Both can appear in one claim. They cover different time periods, so they need different proof. Past wages are usually shown with pay stubs, tax returns and employer records. Future loss depends more on medical opinions and your work history.

Georgia law also separates general damages from special damages. Under O.C.G.A. § 51-12-2: (a) General damages are those which the law presumes to flow from any tortious act; they may be recovered without proof of any amount. (b) Special damages are those which actually flow from a tortious act; they must be proved in order to be recovered.

The practical lesson is simple. A claim backed by records is easier to prove than one built on memory alone.

What Counts as Lost Compensation in Georgia Car Accident Cases?

Lost compensation covers more than the paycheck you stopped receiving. It can include wages, job benefits and the ability to earn in the future.

Your career path matters too. If you were on track for a promotion or a raise, that path can be part of the discussion, not just your current pay. The claim is built from your own history. That includes your job title, pay records, training, performance reviews and the duties you actually performed.

Georgia treats damages as compensation for injury. Under O.C.G.A. § 51-12-4, generally, such compensation is the measure of damages where an injury is of a character capable of being estimated in money. If an injury is small or the mitigating circumstances are strong, only nominal damages are given.

A common mistake is leaving work paperwork at home or letting job records sit unchecked. Gather pay records and job descriptions early, while the details are still fresh.

How Age, Job History and Medical Limits Shape the Value

Age, work history, education, the type of work you did and your medical limits shape the value most. Each one changes how long the loss is likely to last.

Younger workers with limited work history face a different problem. There may be only a few years of pay to point to. In that case, the earning profile is built from training, education and the usual career path in the field the person was entering. School records, certifications and job offers are types of evidence that may be relevant to an earning-capacity analysis.

Medical limits drive the length of the loss. Treating doctors can explain what you can and cannot do, and for how long. Those restrictions help set how far into the future the loss runs.

Future losses also get adjusted. Under O.C.G.A. § 51-12-13, the trier of fact may reduce future lost wages and other economic damages to present value. It may use a 5 percent discount rate or any other rate it considers appropriate. Money paid years from now is worth less today, which is why this step exists.

Medical Opinions and Documentation That Support the Claim

Medical records, work restrictions and treating doctors’ opinions are the core proof that your ability to earn has dropped.

Gaps in treatment are a common problem. When follow-up visits are missed, the record can look thinner than the injury really is. Steady care from the start creates a record that matches what you describe at home and at work.

Georgia also limits how medical bills are proven. Under O.C.G.A. § 51-12-1.1, medical special damages are limited to the reasonable value of medically necessary care. If you have any form of public or private health insurance, including benefits under a governmental workers’ compensation program, Georgia law provides that the evidence relevant to determining the reasonable value of medically necessary care, treatment, or services must cover both what was billed for past, present, or future medical and healthcare expenses and the amounts actually necessary to satisfy those charges under your insurance contract or the applicable governmental workers’ compensation program, regardless of whether the health insurance has been used, is used, or will be used to satisfy those charges. That applies even when the insurance was not used to pay the bill.

When treatment happens under a letter of protection, the letter, itemized charges, referral details, and, if the provider sold the accounts receivable to a third party at less than the invoice price, the third party’s name and the purchase amount are relevant and discoverable. The other side can ask for them.

How Georgia’s 50% Fault Rule Under O.C.G.A. § 51-12-33 Can Bar Recovery

Under Georgia’s fault rule, you recover nothing if you are 50 percent or more responsible for the injury. The O.C.G.A. § 51-12-33 text says the plaintiff “shall not be entitled to receive any damages” at that level of fault.

Below that line, fault works on a sliding scale. Under O.C.G.A. § 51-12-33(a), the judge shall reduce the amount of damages otherwise awarded in proportion to your percentage of fault. If you are found partly responsible for your own injury, O.C.G.A. § 51-12-33 directs the judge to reduce the damages otherwise awarded to you in proportion to your percentage of fault.

In serious crashes, drivers may give different accounts of what happened, which can make fault a point of dispute. The fault finding affects every category of loss, including future earnings. A lower percentage keeps more of the claim in play.

Fault is also split among others who contributed to the harm. Damages are apportioned among the liable persons, and each pays only its own share. A nonparty’s fault is considered only if the plaintiff settled with that nonparty or a defending party gives notice at least 120 days before trial that the nonparty was wholly or partially at fault (O.C.G.A. § 51-12-33(d)(1)).

Timing matters too. Under O.C.G.A. § 9-3-33, actions for injuries to the person generally must be brought within two years after the right of action accrues. Its limit caps what that policy pays, no matter how serious the harm. When the at-fault driver carries too little coverage, your own policy may come into play.

Georgia builds protection for these cases into auto policies.
