Cameron v. Jmp Pizza, Inc (2026)). So the short answer to how long after an accident you can sue for personal injury in Georgia is usually two years. Some claims have shorter notice periods, and some deadlines can pause. This guide explains the main timelines so you can see which clock may apply to you.

The short answer: generally two years from the date of injury

Most Georgia injury lawsuits must be filed within two years after the right of action accrues, but actions for injuries to the person involving loss of consortium must be brought within four years after the right of action accrues. That rule comes from O.C.G.A. § 9-3-33, which covers actions for injuries to the person.

This deadline is for filing a lawsuit in court.

Missing the deadline can bar the claim. That can happen even when the injuries were serious and the other side was clearly at fault. Timing is one of the first things to check, not the last.

If a deadline is weighing on you after a crash or fall that hurt you or someone you love, we're glad to talk it through with you. Many people guess the clock starts when treatment ends or when an adjuster first calls. Those dates can be months away from the injury, so don’t rely on them.

Here is a simple example. Say a crash happened on June 14. Mark that date on a calendar the day you learn about the injury.

Counting from the wrong date is one of the easiest ways to lose time you needed. Write down the exact date of the injury, and keep it with your records from the start.

Deadlines that differ: medical malpractice, government defendants and wrongful death

Medical malpractice follows its own timing. Under O.C.G.A. § 9-3-71, an action generally must be brought within two years after the injury or death occurred. Under O.C.G.A. § 9-3-71(b), in no event may a medical malpractice action be brought more than five years after the date on which the negligent or wrongful act or omission occurred. That five-year limit runs from the act, not from the day you found the harm.

The malpractice rules also reach care at hospitals, clinics and nursing homes. O.C.G.A. § 9-3-70 covers claims from care by licensed providers, by any person acting under the supervision and control of a lawfully authorized provider, and by facilities and their employees acting within the scope of employment. A nursing home injury can fall under these rules.

Government defendants move much faster. A claim against a city must be presented in writing to the city’s governing authority within six months of the event the claim is based on, and no lawsuit can proceed until that is done, under O.C.G.A. § 36-33-5. Claims against counties must be presented within 12 months after they accrue or become payable or the same are barred, under O.C.G.A. § 36-11-1, provided that minors or other persons laboring under disabilities shall be allowed 12 months after the removal of the disability to present their claims.

Wrongful death has its own rules about who may sue. When no one is entitled to bring the action, the administrator or executor may bring it for the next of kin, under O.C.G.A. § 51-4-5. The timing depends on the facts, so have these claims reviewed early.

What can pause or change the deadline

Some rules pause the clock. Tolling means the clock stops running for a period set by law.

A minor can have more time. Under O.C.G.A. § 9-3-90, a person under 18 when the claim arises generally gets the same time after turning 18 as other people do. The same section also gives people who are legally incompetent because of intellectual disability or mental illness when the claim arises the same time to sue after the disability is removed.

A criminal case can also pause the clock. Under O.C.G.A. § 9-3-99, the time for a tort claim by the victim of an alleged crime committed in Georgia, where the claim arises out of the facts and circumstances of that alleged crime, is tolled from the date of the commission of the alleged crime or the act giving rise to the claim until the prosecution has become final or otherwise terminated. That tolling cannot exceed six years, except as otherwise provided in Code Section 9-3-33.1.

A rule that fits one injured person may not fit another. A parent, adult child or other family member can have a different claim and a different clock. Ask about each person’s dates separately.

How long a personal injury case can take after filing

A lawsuit can settle before trial or continue through the court process. Cases can run longer when the sides don’t agree on fault or on the value of the injuries. The length depends on the facts of each case.

Several things shape the timeline. These include whether medical treatment is still ongoing, how many parties and insurers are involved, and how busy the court’s calendar is. An injury that hasn’t stabilized often means its full impact isn’t known early.

That is one reason to review the deadline before settling. Waiting until the case is nearly over can leave little time to file if the deadline is close.

Why waiting can cost evidence, and first steps to protect a claim

Evidence gets harder to find as time passes. Photos, vehicle damage, witness names and medical records can be lost, changed or forgotten. Surveillance video is often overwritten within days, so early requests matter.

A crash can involve more than one deadline at once.

Start a simple file today. Keep every medical record, bill, photo and letter about the accident in one place, with dates. If there was no police report, or the driver left the scene, mention that when you talk with a lawyer.

Quick answers to common questions

How long after an accident can you sue for personal injury in Georgia?

For most personal injury lawsuits, Georgia generally allows two years from the injury. Medical malpractice and government claims can follow different timing.

Does filing an insurance claim stop the two-year clock?

An insurance claim is not the same as a lawsuit.

Does a minor have longer to file?

Under Georgia law, a minor generally gets the same time after turning 18 as other people.
