Cameron v. Jmp Pizza, Inc (2026)). Families who lose someone in a truck crash often ask how long to file wrongful death truck crash Georgia cases allow, and whether that same clock applies to them. This guide answers that question and explains why truck cases call for early attention.

The Short Answer: Generally Two Years to File

Georgia generally gives injury claims two years. Under O.C.G.A. § 9-3-33, actions for injuries to the person must be brought within two years after the right of action accrues. The statute opens with “except as otherwise provided,” so other rules in the same article can change that period. Treat two years as the starting point, not the final word.

The two years run from accrual, the point when the right of action begins. That makes the start date one of the first facts to pin down. Waiting for records or insurance answers uses up the same window, so the calendar keeps moving while the family gathers information. For a broader view of how these claims work, read our truck accident lawyer Georgia guide.

If your family is weighing a wrongful death claim after a loved one died in a truck crash, our team can walk through the timeline with you. That statute says a surviving spouse may recover for the homicide (a death caused by another’s wrongful act) of a spouse or parent. The recovery is the full value of the life of the decedent, as shown by the evidence.

If there is no surviving spouse, a child or children may recover. Under O.C.G.A. § 51-4-2, the surviving spouse or, if there is no surviving spouse, a child or children, either minor or sui juris, may recover for the homicide of the spouse or parent. Section 51-4-2 does not cover funeral, medical or other necessary expenses; it lets the surviving spouse or, if there is no surviving spouse, a child or children recover for the homicide of the spouse or parent the full value of the life of the decedent, as shown by the evidence.

The statute also protects the spouse’s share. The surviving spouse receives no less than one-third of the recovery under § 51-4-2. This statute answers several questions, including who brings the claim, what it covers, and how any recovery is divided among the surviving spouse and the children. The time limit comes from § 9-3-33, so keep these two rules separate in your mind.

Why the Two-Year Clock Matters More in Truck Crash Cases

Truck crashes usually leave more records behind than a car crash does. Many of those records sit with the trucking company, not the family. That gap is why the timeline gets tight.

Many commercial trucks use an electronic logging device (ELD). Under 49 CFR 395.26, the ELD automatically records the date, time, truck location, engine hours, vehicle miles, driver identification, vehicle identification and motor carrier identification. Those entries are data, and they only help if someone asks for them and keeps them.

49 CFR 379.7 addresses how records may be preserved. The format matters less than whether the record stays accurate and easy to reproduce.

Requests take time. Someone has to ask for the records, review them, and compare them with the police report and photos. Starting that work early gives the case room to develop inside the two-year window.

Who May Be Responsible for a Truck Crash Death

More than one party can share responsibility after a truck crash. The driver, the trucking company and, in some cases, the owner of the truck may each have a role. Each one’s role has to be looked at on its own facts.

Georgia law sorts out fault among everyone who contributed to the injury. Under O.C.G.A. § 51-12-33, the court or jury assigns a percentage of fault to each person or entity involved. The statute says the fault of all contributors counts, whether or not each one was named in the suit.

Each liable person then pays only its own share. Those damages are not joint liability, and they are not subject to any right of contribution. In plain terms, no one pays another’s share.

The statute also bars recovery in one case. If the plaintiff is 50 percent or more responsible for the injury or damages, the plaintiff gets no damages under § 51-12-33 (Quynn v. Hulsey (2020))(g). Because no one covers another’s share, identifying each possible responsible party early keeps the picture complete.

How Insurance Limits Affect the Timeline

Federal rules set minimum financial responsibility for many commercial trucks. 49 CFR 387.9 lists $750,000 as the minimum for for-hire carriage of nonhazardous property in interstate or foreign commerce, for vehicles rated 10,001 pounds or more.

49 U.S.C. § 31139 covers that requirement. Its proof must be enough to pay final judgments for death or injury from negligent operation. 49 U.S.C. § 31139 reads: “except that the amount of the financial responsibility must be sufficient to pay not more than the amount of the financial responsibility for each final judgment against the motor private carrier for bodily injury to, or death of, an individual resulting from negligent operation, maintenance, or use of the motor vehicle, or for loss or damage to property, or both.”

Under O.C.G.A. § 40-1-112, a person may join the carrier and its insurer in one action only in limited situations.

An insurance claim and a lawsuit are different steps. A family may deal with an insurer while the calendar keeps running. Keep track of both, and write down the dates each one sets.

Steps Families Can Take Now

Start with the paperwork and the dates. Clear records help the family make decisions inside the time limit, and they give anyone reviewing the case a clear starting point.

Keep the crash report, photos, medical bills and funeral bills.

Save every letter from an insurer or the trucking company.

Write down the crash date, the date of death, and the names of anyone who saw the crash.

Do not give a recorded statement or sign a release until you know what it covers.

Funeral and medical receipts matter. The personal representative may recover those costs under O.C.G.A. § 51-4-5 when the death results from a crime or from criminal or other negligence, so keep every receipt, even the small ones.
