Local police, sheriff’s deputies or the Georgia State Patrol usually respond first, and each creates its own record. The trucking company and both insurers may also open files. This guide explains who does what and why some records need attention early. T. Madden & Associates, P.C. has practiced personal injury law since 1999 and has an office in Jonesboro, in Clayton County.

Who Responds at the Scene of a Semi-Truck Crash in Clayton County?

Local police or sheriff’s deputies usually respond to crashes on city and county roads. The Georgia State Patrol commonly works crashes on interstate highways, such as I-75, I-285 and I-675, that run through the county.

Fire and EMS crews respond when people are hurt. If a fire truck or other emergency vehicle is involved, its own agency may also be part of the picture.

The first agency on scene creates the first official record. That record usually notes the time and place, where the vehicles came to rest, and any injuries. These early details are hard to rebuild later, so write down what you remember while it is fresh.

If a semi-truck crash in Clayton County has left you or someone you love hurt, our team is glad to talk through what happens next. It typically lists the drivers, vehicles, passengers, witnesses, road conditions and the officer’s observations. Many reports include a diagram, citations and notes on contributing factors.

Reports can be updated after follow-up work, so the first version is not always the final one. To get a copy, ask the agency that responded how to request it.

The report is important, but it does not decide fault on its own. Fault is weighed against all the evidence, including driver accounts, physical damage, witness statements and the trucking company’s records.

What Records Does the Trucking Company Keep After a Crash?

The trucking company keeps logs, maintenance files and driver records. Federal rules set minimum keeping periods for several of them.

Motor carriers subject to the federal duty-status rule must require each driver to record duty status for each 24-hour period, except private motor carriers of passengers (nonbusiness). Carriers must also keep an accident register for 3 years after each accident, under the federal accident-register rule. That rule also requires carriers to give authorized investigators reasonable help.

A driver qualification file is kept while the driver works for the carrier and for three years after, under the driver file rule.

After eight hours, it must stop trying. The post-accident testing rule requires the employer to record the reasons if an alcohol test is not administered within two hours, and to stop trying to administer it after eight hours.

Because some records are kept only for set periods, early written requests to preserve them can matter.

Do Insurers and Adjusters Investigate Too?

Yes. The truck’s insurer and the injured person’s insurer each open a claim file. Adjusters gather statements, photos and records to evaluate the claim. Before you give a recorded statement, it helps to know what the adjuster is asking and why.

Georgia’s fault rule also shapes how a claim is valued. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault. A person 50 percent or more responsible recovers nothing.

Crashes involving government vehicles follow different notice steps. A claim against a city must be presented in writing to its governing authority within six months of the event upon which the claim is predicated, under O.C.G.A. § 36-33-5. A claim against the state requires written notice within 12 months of the date the loss was discovered or should have been discovered, sent by certified mail or statutory overnight delivery, return receipt requested, or delivered personally to and a receipt obtained from the Risk Management Division of the Department of Administrative Services, with a copy delivered personally or mailed by first-class mail to the state government entity whose acts are the basis of the claim, under O.C.G.A. § 50-21-26.

These notice periods can be shorter than the standard lawsuit deadline. A crash involving a county, city or state vehicle, such as a fire apparatus, can trigger these steps.

How Does a Personal Injury Firm Investigate Alongside the Official Record?

A personal injury firm works to build the injured person’s side of the picture. Its lawyers can gather scene photos, vehicle damage details, witness contact information and medical records.

They can also send written requests to the trucking company for records and ask that those records be preserved. The firm then compares those records with the crash report to see where the information lines up and where it differs.

Accident reconstruction, a technical review of how the crash happened, may be used in some cases. Whether it fits depends on the facts of the crash and the injuries involved.

Our team at T. Madden & Associates, P.C. has practiced since 1999. Terance Madden is the responsible lawyer for this page.

Talking With Our Team About a Clayton County Truck Crash

You don’t need every record in hand to ask questions.
