Georgia can charge a driver who leaves the scene of a crash with a misdemeanor, and the charge level depends on what the crash caused. The offense is about what the driver had to do after the crash, not only the impact itself.

Many people who search this question were not the driver. They were hit, or they’re helping a family member who was. Either way, the first step is understanding how the criminal side and the injury side fit together.

Keep two tracks apart. The criminal case is between the driver and the state. The injured person’s civil claim is a separate track aimed at compensation for injuries and losses, with its own steps and deadlines. For the broader picture of car and truck crash claims, read our truck and car crash guide.

If a driver left you hurt, or someone you love was hit and never stopped, we're glad to talk through the facts of that crash with you. The Driver Services crash guidance lists stopping, notifying law enforcement, providing information, and leaving identifying information after damaging an unattended vehicle.

Those duties are the heart of the offense. The law looks at what the driver did after the crash, not only how the crash happened. A driver who skips any of these steps may face a charge.

For an injured person, a useful question is whether the driver stopped and shared identifying information. The answer shapes the police record and the facts your claim will rely on. A police crash report is the official record of what happened at the scene, so it’s worth getting early. You’ll find out how to request one later in this guide.

How the Charge Changes: Property Damage, Injury, or Death

The charge depends on the harm the crash caused. Georgia treats a hit-and-run that causes only property damage differently from one that causes injury or death. The more serious the harm, the more serious the charge can be.

Facts at the scene drive this. Investigators and prosecutors look at whether anyone was hurt and how badly. Injuries don’t always show up right away, though. Someone who felt fine at the roadside may feel worse hours or days later, so a medical check after any crash is important.

If you’re the injured person, start with a simple list. Write down what hurt, where, when the pain started, and what the vehicles looked like afterward. If you’re helping someone else, ask the same questions and write the answers down while they’re fresh.

What Penalties Depend On in a Hit-and-Run Case

No single penalty fits every hit-and-run case, because the specific charge and the court process shape what happens.

That’s a point about process, and it matters to a family watching a case move. An arrest or a court appearance is part of how the criminal side moves forward. It runs separately from the injured person’s claim.

The penalty itself turns on the specific charge and what the court decides. The charging papers and the court record are where those details live, so keep copies of anything you receive.

Hit and Run Involving Death or Serious Injury

The same duties to stop and share information still apply when someone dies or is seriously hurt. What changes is the weight of the harm. That weight shows up in the criminal charge and in the options open to the family.

When death results from a crime or from criminal or other negligence, Georgia’s wrongful death statute entitles the personal representative to recover funeral, medical, and other necessary expenses. The personal representative is the person appointed to handle the deceased person’s estate.

Families in this position often face many questions at once. Keep the medical bills, funeral receipts, and the crash report together in one place. That makes it easier to see what the family has already paid and what records exist.

How Hit-and-Run Cases Are Investigated

Law enforcement leads the investigation, and the evidence it gathers can shape what happens next. Common sources include surveillance footage, witness statements, damage patterns on the vehicles, and license plate data. Not every case has all of these, so early notes from the injured person matter.

You can help with the facts you control. Write down the other vehicle’s color, make, body style, and any part of the plate you saw. Note the location and the time. Keep photos of the damage and of your injuries, and save the names and phone numbers of anyone who saw the crash.

Crash records matter too. Your own records support your claim, whatever happens in the criminal case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

License Consequences of a Georgia Hit-and-Run Conviction

A conviction can affect the driver’s license, and the effect depends on the offense and the driver’s record.

License action is part of the criminal outcome. It is separate from the injured person’s right to seek compensation. Keep the two straight, so a license issue isn’t confused with the civil claim.

Options for Recovering Compensation After a Hit and Run

The injured person’s civil claim is a separate track, so a criminal conviction is not the only route. Georgia generally gives two years to bring an action for injuries to the person. Under O.C.G.A. § 9-3-33, that two-year period applies, with exceptions the statute itself sets out.

Under O.C.G.A. § 9-3-99, for a tort action by the victim of an alleged crime committed in this state, the period is tolled, or paused, from the commission of the crime until the prosecution has become final or otherwise terminated. That pause may not exceed six years, except as otherwise provided in Code Section 9-3-33.1.

A common mistake is assuming the civil side must wait for the criminal case to finish. The two run separately, and the deadlines come from statute.

If the driver cannot be identified, your own auto policy may matter. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

Fault matters too.
