Ask the carrier and its insurer to keep the original records, not summaries. Some truck records have set minimum keeping periods, but crash data can be overwritten, so timing matters. This guide explains what each record is, how long it’s kept, and what to ask for now. T. Madden & Associates, P.C. has been in practice since 1999 and represents people hurt in truck wrecks in Georgia.

What a Truck Black Box and ELD Record Are

A truck’s black box is its event data recorder, or EDR. The ELD is a separate electronic log of the driver’s hours. The EDR is a crash-data module that can store vehicle speed, braking and related data from the seconds around a crash. The electronic logging device (ELD) records the driver’s duty status. Federal rules require a driver to record duty status for each 24-hour period, as set out in 49 CFR 395.8.

Trucks hold other useful data, too. The engine control module may store fault codes. Carriers also keep supporting documents, such as dispatch records, trip records and expense receipts. 49 CFR 395.11 lists these, including electronic mobile communication records sent through a fleet management system. Each source tells a different part of what happened on the road. That’s why one request rarely covers everything you need.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Long Black Box and ELD Data Is Kept

Federal rules require a motor carrier to keep driver records of duty status and supporting documents for at least six months from the date of receipt. That is the clearest federal retention rule for truck logs. 49 CFR 395.8 sets this out. A carrier must also keep a back-up copy of ELD records for six months on a separate device, under 49 CFR 395.22.

Crash module data works differently. How long it lasts depends on the equipment and on who controls the truck. Normal vehicle operation or repair work can overwrite stored data. So the sooner a written request goes out, the less time the data has to be lost.

Carriers must also keep an accident register for three years after each accident. 49 CFR 390.15 requires the accident register to contain at least the date, the city or town where the accident occurred and the State, the driver’s name, the number of injuries, the number of fatalities, and whether hazardous materials, other than fuel spilled from the fuel tanks of the vehicle involved, were released. The register also includes copies of required accident reports. Those details help you ask for the right records by name.

What Triggers an EDR to Record a Crash

Many EDRs lock a crash event when their sensors detect a sudden change in speed. The trigger points are set by the module’s design, so they vary by make and model. A locked event usually holds a short window of data from just before and during the impact. That window is why the exact timing of the crash matters.

Investigators often compare that window with the driver’s logs and dispatch records. Matching times across the records helps show what happened in order. A missing or mismatched time stamp is a reason to ask questions early. Ask the carrier for the original time-stamped records, not a retyped version, so the times can be checked.

Who Can Access the Data After a Crash

The truck’s owner, the motor carrier, and anyone with access to the module or ELD system can usually retrieve the data. A download generally needs the right tools and access. Don’t assume the record is still intact because the truck still exists. Federal rules require a motor carrier to make accident records available to authorized representatives within such time as the request or investigation may specify, and to give reasonable help with an investigation, under 49 CFR 390.15.

Drug and alcohol testing creates a separate record. After certain truck crashes, the employer must test each surviving driver as soon as practicable. 49 CFR 382.303 lists the triggers. If an alcohol test is not given within 2 hours, the employer must keep a record of the reasons. The alcohol test window ends at 8 hours. The controlled substances window ends at 32 hours.

Insurers and other parties may request the same records. Send your preservation requests before the truck is repaired or returned to service.

Why Preservation Matters Under Georgia Law

Evidence can be lost through destruction, failure to keep it, or failure to produce it when it matters to the case.

Georgia state law also ties motor carriers to federal rules. O.C.G.A. § 40-1-8 requires every commercial motor vehicle to be kept in a safe condition at all times. The same statute requires carriers to follow the hours-of-service and record-of-duty-status rules in 49 CFR Part 395.

A written preservation demand helps show what the other side knew and when it knew it. That record can matter if evidence goes missing later. Keep copies of every letter and proof of delivery.

Steps to Take Right After a Truck Crash

Write down the carrier’s name, the DOT number, and the truck and trailer numbers. Take photos of them if you can. Then send written requests that name the original records. Here is what to ask for in writing:

ELD logs and the driver’s records of duty status

Dispatch, GPS and fleet messages

Fault codes and the crash data download

Maintenance and inspection records

Post-accident testing records, including reasons for any test not given on time

Also keep your own photos of the truck, the damage and the scene. Note any towing or repair dates. Those dates show when the truck was moved or changed.

Ask for originals, not summaries. 49 CFR 395.30 bars a motor carrier from altering or erasing the original hours-of-service information or the source data behind it. Send your preservation letter to the carrier, its insurer, and anyone else who holds the truck or the data.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Black Box Data Connects to Other Issues in a Truck Case

Black box and ELD records can bear on several questions at once. They can show who was driving, how the truck was kept up, and who may be responsible. Claims can reach more than the driver.

Georgia law also covers punitive damages. Those damages can be awarded only when clear and convincing evidence shows willful misconduct, malice, fraud, wantonness, oppression, or an entire want of care that raises a presumption of conscious indifference to consequences. O.C.G.A. § 51-12-5.1 says punitive damages are meant to punish or deter, not to compensate the injured person. Maintenance, logs and crash data are the kinds of records that can help prove those facts.

Frequently Asked Questions About Truck Black Box and ELD Data
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How do you preserve truck black box data after a crash in Georgia?

Send written requests to the carrier and its insurer soon after the crash.
