A totaled car after accident claim comes down to two questions: what the car was worth before the crash, and who pays for that loss. This guide walks through how Georgia handles both.

What a Totaled Car Claim Is and Who It Is For

A totaled car claim asks for payment for a vehicle that costs more to repair than it’s worth, or that the insurer calls a total loss.

Who files depends on whose insurance pays. A third-party claim goes to the insurer of the driver who caused the crash. A first-party claim goes to your own collision coverage, which pays for damage to your car under the policy you bought.

Family members can have a role too. If you own the car, the claim is usually yours to make. If a family member owns it, that person’s name usually goes on the claim.

Property damage can be handled apart from an injury claim. You can settle the car while your injuries are still being treated, but the two claims are separate and should be reviewed separately. For the wider picture, read our Georgia car accident guide.

If your car was totaled and you're still waiting on an insurer's number, you don't have to work through it alone; our team can talk it over in a free first consultation. The process typically follows four steps.

Inspection. An adjuster checks the car, including frame, structural and airbag damage. Hidden damage can change the repair estimate.

Comparison. The insurer compares the repair estimate with the car’s value just before the crash. When repairs approach or exceed that value, the car is often declared a total loss.

Salvage value. The insurer sets a salvage value, which is what the damaged car would sell for. A higher salvage value usually lowers the payout to you.

Written determination. The insurer issues a total loss determination in writing. Ask for it in writing, and read every number on it.

The line for a total loss is not the same everywhere. It can differ by insurer, the car’s age and condition, and its market value.

How the Vehicle’s Value Is Set and What a Claim Can Include

A total loss payout often starts with the car’s actual cash value (ACV). That is what the car was worth just before the crash.

Insurers look at comparable vehicles with the same year, make, model and mileage. Options and condition count too.

Gaps often come from missing records. Recent upgrades, new tires, a new engine or a documented service history may not appear in a standard valuation. Keep receipts and photos, and send them to the insurer in writing.

A total loss claim may also include other costs:

Sales tax, title and registration fees

Towing and storage charges

Personal items left inside the car

Diminished value is different. It is the lost market value after a damaged car is repaired. Whether it applies to your claim depends on the facts.

Georgia Law on Totaled Vehicles and Whether You Can Sue

Georgia law reduces what you can recover if you share the blame for the crash. This is the most important rule in a property damage claim.

Under O.C.G.A. § 51-12-33, damages are reduced in proportion to your percentage of fault. If you are 50 percent or more responsible for the injury or damages claimed, you are not entitled to receive any damages.

The same statute says each at-fault party pays only its own share. Those shares are not joint liability.

Another rule can apply. Under O.C.G.A. § 51-11-7, if you could have avoided the harm caused by the other driver’s negligence with ordinary care, you cannot recover for it.

If the at-fault driver has no insurance, your own coverage may help. O.C.G.A. § 33-7-11 requires auto policies to include uninsured motorist provisions that can pay for property damage. The Georgia Department of Revenue notes that certain Georgia vehicles must carry liability insurance.

Georgia sets time limits for filing suit, and they vary by claim type. Acting early keeps your options open.

Fault is proven with the police report, witness statements and phone records. The same evidence can support both the car claim and any injury claim. See how dashcam and vehicle data can show fault.

What to Expect: A Step-by-Step Total Loss Timeline

Expect the claim to move in stages, from the scene to the final paperwork.

Report the crash. Notify police and your insurer promptly, and get the police report. The Georgia auto claim tips from the Georgia Office of the Commissioner of Insurance list these steps. They also advise avoiding statements about fault.

Document the car. Take photos, keep the repair estimate, and save receipts for add-on equipment and maintenance.

Review the inspection. When the insurer issues its total loss determination, go through the valuation line by line.

Review the offer. Compare it with your documented value, and ask for the valuation report in writing. An early offer deserves careful review, as explained in why first settlement offers need a look.

Negotiate. Present your documents, then decide whether to accept or dispute the figure.

Settle. Finish the title transfer, lien payoff and salvage paperwork.

Timing varies by claim. Each stage can take longer when the insurer disputes fault or value.

Why Clients Work With T. Madden & Associates, P.C. on Property Damage Claims

T.
