People often ask whether a truck driver has to take a drug test after a crash in Georgia. The answer comes from federal rules that apply to commercial motor vehicles on public roads. Post-accident testing rules set specific triggers.

The key point is that a truck being involved is not enough. The crash has to meet one of the federal triggers. Some crashes clearly do, such as a crash that causes a death. Others turn on details like a citation, an injury treated away from the scene, or a vehicle that has to be towed.

This page walks through those triggers, the time limits, what the drug test screens for, what a result can and cannot show, and which records matter. It also covers Georgia’s filing deadline, because timing affects any injury claim. If you were hurt, or someone in your family died, the testing paperwork can become part of the evidence in your case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Which Truck Crashes Trigger Federal Post-Accident Testing

Federal post-accident alcohol testing applies after a crash that involves a death. It also applies after certain crashes that involve a citation plus injury or towing. Under § 382.303, as soon as practicable following an occurrence involving a commercial motor vehicle operating on a public road in commerce, each employer must test for alcohol each of its surviving drivers who was performing safety-sensitive functions with respect to the vehicle, if the accident involved the loss of human life. A citation is not needed for that trigger.

Under the federal regulation at section 382.303(a) of the Code of Federal Regulations, each employer must, as soon as practicable after an occurrence involving a commercial motor vehicle operating on a public road in commerce, test for alcohol each surviving driver who receives a citation within 8 hours of the occurrence under state or local law for a moving traffic violation arising from the accident, if the accident involved bodily injury to a person who, as a result of the injury, immediately receives medical treatment away from the scene, or one or more motor vehicles incurring disabling damage that requires them to be transported away from the scene by a tow truck or other motor vehicle; the same section sets a thirty-two-hour citation window for controlled-substances testing under the same conditions. If the accident involved loss of human life, testing covers surviving drivers who were performing safety-sensitive functions with respect to the vehicle. For a crash that does not involve a fatality, the citation-based trigger applies only when the driver also receives a citation for a moving traffic violation arising from the crash, and the crash involved either bodily injury that leads to immediate medical treatment away from the scene, or one or more vehicles with disabling damage that requires them to be transported away from the scene by a tow truck or other motor vehicle. The citation-based controlled substances test covers a surviving driver who receives a citation within thirty-two hours of the occurrence. In both cases, the citation must be issued under State or local law for a moving traffic violation arising from the accident.

In plain terms, a minor crash with no citation and no injury treated away from the scene may not trigger the federal requirement. The facts decide it. Police and citation records are usually where those facts show up.

A urine drug test run by law enforcement can also count. Under the same section, it can meet the federal requirement if it follows applicable testing rules and the employer obtains the results.

Time Limits for Alcohol and Drug Tests After a Crash

The rule calls for testing as soon as practicable, and it sets firm clocks after that. Here are the windows that matter:

Alcohol, two hours. If the test is not given within two hours, the employer must keep a record of why it was not promptly given.

Alcohol, eight hours. If the test is still not given within eight hours, the employer must stop trying and keep that record.

Drugs, 32 hours. If the controlled-substances test is not given within 32 hours, the employer must stop trying and keep a record of the reasons.

The driver has limits too. Under § 382.209, a driver required to take a post-accident alcohol test may not use alcohol for eight hours following the accident, or until he or she undergoes a post-accident alcohol test, whichever occurs first. The driver also may not drink until the test is done, whichever comes first.

These clocks matter because a sample taken closer to the crash sits closer in time to what happened on the road. A missed window does not erase the test question. It leaves a written record that asks why the test was late or never happened. That record can become part of a claim review.

What the Post-Crash Drug Test Screens For

Federal drug testing covers specified substances. The FMCSA list of tested substances explains which substances federal DOT testing covers.

Each employer must also ensure that its alcohol and controlled substances testing complies with the federal testing procedures in part 40 of this title. Those procedures govern collection and lab steps.

A panel result tells you that a listed substance was found in the sample. It does not tell you how the driver was behaving at the wheel, or how the crash happened. Those are separate questions for other evidence. When you review a result, ask what was tested, when the sample was taken, and how it was handled.

What a Drug Test Can Show and What It Cannot Settle

A test shows whether a listed substance was detected in the sample at the time it was collected. On its own, it does not settle who caused the crash. It also does not show how far the driver was from the crash or how impaired the driver was.

Other evidence often matters alongside test results. That includes police reports, crash reconstruction, driver logs, dash camera video, and witness accounts. Each one can show a different part of what happened.

A positive result has federal consequences for the driver. Under § 382.215, a driver who tests positive, or who has adulterated or substituted a test specimen for controlled substances, may not report for duty, remain on duty or perform safety-sensitive functions. An employer that knows of the result may not let the driver keep doing those functions. A negative result raises its own questions about timing and handling.

Under § 382.211, a driver may not refuse to submit to a required post-accident alcohol or controlled substance test. No employer may let a driver who refuses keep performing safety-sensitive work.

It’s easy to read too much into one result. A test is one piece of a larger record.

Other Drug Testing Truck Drivers Can Be Subject To

Federal rules cover more than post-crash testing. A reasonable-suspicion test must rest on observations, not a hunch. Under § 382.307, the determination that reasonable suspicion exists must be based on specific, contemporaneous, articulable observations concerning the appearance, behavior, speech or body odors of the driver. A signed written record must be made within 24 hours of the observed behavior, or before results are released, whichever is earlier.

Each type of test creates different paperwork. A reasonable-suspicion record is built around the observations of the supervisor or company official who made them. A post-crash record is built around the timing of the crash and the sample collection.

The Drug and Alcohol Clearinghouse is the federal database that holds certain violation information. Under § 382.701, an employer must conduct a pre-employment query of the Clearinghouse before employing a driver subject to controlled substances and alcohol testing to perform a safety-sensitive function. The employer must also query it at least once a year. Under § 382.705, medical review officers must report to the Clearinghouse within 2 business days of making a determination or verification.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Testing Records That Can Matter in a Truck Crash Claim

Post-crash testing paperwork can be important evidence. Employers must keep documents generated in connection with decisions on post-accident tests. Under § 382.401, the specific types of records an employer must maintain are listed in that section.

Retention periods vary. Negative controlled-substance results and alcohol results below 0.02 need to be kept for a minimum of one year. Collection-process records need to be kept for two years.

Timing also matters in an injury claim. A negative result needs to be kept for a minimum of one year. Timing matters when you ask for these records, so early requests and written preservation requests matter.

Driver hours and duty-period records often sit alongside drug and alcohol records when a crash is reviewed. Carriers and insurers control many of these records. Evidence preserved early is easier to review later.

How a Georgia Truck Crash Claim Is Handled Locally

Georgia generally gives two years to sue for injuries to the person (O.C.G.A. § 9-3-33; Cameron v.
