Federal rules require a trucking company to test its driver for alcohol and drugs after some crashes involving a commercial truck, not after every one. This page explains when a truck driver drug test after crash rules apply in Georgia and how fast each test must happen.

The Short Answer: Yes, in Certain Crashes

Federal law requires post-accident testing only in specific situations. The rule is found in 49 CFR 382.303. Under this federal rule, this part applies to service agents and to every person and to all employers of such persons who operate a commercial motor vehicle in commerce in any State and are subject to the commercial driver’s license requirements of part 383 of this subchapter, the Licencia Federal de Conductor (Mexico) requirements, or the commercial drivers license requirements of the Canadian National Safety Code. Whether a test was required in your crash depends on the facts. Those facts include what happened, who was hurt, and whether a vehicle had to be towed away.

If a commercial truck was involved in your Georgia crash, the testing timeline can be hard to sort out alone. If the crash caused the loss of human life, the employer must test each surviving driver who was performing safety-sensitive functions with the vehicle.

The second and third situations both require a traffic citation. The driver must receive a citation under state or local law for a moving traffic violation arising from the crash. Under this federal rule, as soon as practicable after an occurrence involving a commercial motor vehicle operating on a public road in commerce, an employer shall test a surviving driver for alcohol if that driver receives a citation within 8 hours of the occurrence under State or local law for a moving traffic violation arising from the accident, and shall test for controlled substances if the citation comes within thirty-two hours of the occurrence, when the accident involved the circumstances the rule lists.

The citation must also go with one of two conditions. The second situation is bodily injury to someone who immediately gets medical treatment away from the scene. The third is a vehicle with disabling damage that must be towed away. A citation alone does not meet this part of the rule.

How Fast the Tests Must Happen

Testing must happen as soon as practicable. The rule also sets separate time limits that people often mix up.

2 hours: If an alcohol test isn’t given within 2 hours, the employer must keep a written record of why it wasn’t promptly given.

8 hours: If the alcohol test isn’t given within 8 hours, the employer must stop trying to give it and keep that same record.

32 hours: A drug test follows the same crash conditions but has a 32-hour limit. After that, the employer must stop trying and record the reasons.

Under this federal rule, no driver required to take a post-accident alcohol test under § 382.303 shall use alcohol for eight hours following the accident, or until he/she undergoes a post-accident alcohol test, whichever occurs first. The driver must also stay available for testing. Under this federal rule, nothing in this section shall be construed to require the delay of necessary medical attention for injured people following an accident.

Why the Timing Matters for Your Claim

Timing matters because test records are evidence. Under this federal rule, each employer must maintain for a minimum of five years records of driver alcohol test results indicating an alcohol concentration of 0.02 or greater, and records of driver verified positive controlled substances test results. It must also keep documents created when it decides on post-accident tests. Those records must be available for federal inspection within two business days after a request.

Driver logs matter too. Under this federal rule, a motor carrier shall retain records of duty status and supporting documents for each of its drivers for a period of not less than 6 months from the date of receipt.

Fault rules also shape a claim. Under O.C.G.A. § 51-12-33, Georgia damages are reduced by the injured person’s percentage of fault. A person who is 50 percent or more responsible recovers nothing.

Records to Ask About After a Georgia Truck Crash

The most useful records show when and how testing happened. Start with the police crash report and any citation issued to the driver. Medical records showing transport from the scene, and tow records for any vehicle moved from the scene, also help.

Keep your own records too. Save photos, dates, witness names and bills. Log retention can run out after 6 months, so early requests for records help.

Georgia generally requires a personal injury lawsuit to be filed within two years.

Crashes in Clayton County and Jonesboro

A crash in Jonesboro or elsewhere in Clayton County follows the same federal clock as a crash in Atlanta, Macon or Augusta. The FMCSA’s testing guidance explains which drug and alcohol tests are required and when they occur.

T. Alcohol testing applies to a surviving driver who was performing safety-sensitive functions if the accident involved the loss of human life, or to a driver who receives a citation within 8 hours of the occurrence for a moving traffic violation arising from the accident if the accident involved bodily injury with immediate medical treatment away from the scene, or disabling damage requiring a motor vehicle to be transported away from the scene by a tow truck or other motor vehicle. Controlled-substances testing uses the same triggers, except that the citation must be received within thirty-two hours of the occurrence. Georgia drivers covered by these federal rules must follow them."}}, {"@type": "Question", "name": "How soon after a truck crash must the drug test be done?", "acceptedAnswer": {"@type": "Answer", "text": "Under this federal rule, when a required alcohol test is not administered within two hours following the accident, the employer shall prepare and maintain on file a record stating the reasons the test was not promptly administered; when a required controlled substances test is not administered within 32 hours following the accident, the employer shall cease attempts to administer that test and prepare and maintain on file a record stating the reasons it was not promptly administered. If the alcohol test is not done within 2 hours, the employer must write down why, and it must stop trying after 8 hours."}}, {"@type": "Question", "name": "What happens if a truck driver refuses a post-crash drug test?", "acceptedAnswer": {"@type": "Answer", "text": "Under federal rules, a driver who is subject to post-accident testing must remain readily available for such testing, or the employer may deem the driver to have refused to submit to testing.
