PROGRAM OVERVIEW
These Terms & Conditions (“Terms” or “T’s & C’s”) govern your participation in the Rewards Program (the “Rewards Program” or the “Program) offered by T. Madden & Associates, P.C. (“TMAPC”). By participating in this Program, you agree to be bound by these Terms.
Program Eligibility
- Participants: The Program is open to licensed attorneys who enter into a co-counsel agreement with TMAPC; and
Eligible Cases: Rewards are earned on cases resulting in a monetary recovery via settlement or verdict.Participation is open to approved referral partners invited by T. Madden & Associates P.C. (“TMAPC”). Participants must:
- Be authorized representatives of their firm or organization.
- Be located in the U.S. and 18 years or older.
- Maintain good-standing professional relationships with TMAPC and their respective State Bar(s).
TMAPC reserves the right to verify eligibility and decline participation at its discretion.
2. Referral Definition & Qualification
A Qualified Referral is defined as:
- A new client who is not currently or previously engaged with TMAPC, nor who previously spoke to TMAPC about representation on the matter prior to the referral by the referring party.
- A client who retains TMAPC and completes a contract for legal fees.
- A referral submitted through an approved method—either via Referral Rock or directly to a TMAPC. If submitted directly, TMAPC will log the referral in Referral Rock to ensure accurate tracking and streamlined program management. TMAPC intends to also load the case into our case management program and add the name of the referring attorney.
Duplicate, nor unqualified referrals, nor referrals that fail to maintain its client relationship though the time of monetary distribution will not be eligible for reward points.
3. Rewards
- Referral reward points are based on attorney fees retained by TMAPC from the settlement or verdict recovery from the referred case after all repayment of case costs, administrative fees and client distributions.
- Reward points are issued in addition to any existing CoCounselAttorney fee Agreements.
Participants may receive:
- Recognition and premium gifts at milestones (e.g., 1st, 5th, and 10th referrals).
- Invitations to exclusive events such as the End-of-Summer Soirée.
- Eligibility for larger experiences (e.g., Lakehouse getaway) for top-tier referral partners.
TMAPC may substitute rewards of equal or greater value and may modify incentives at any time at TMAPC’s sole discretion.
4. Tracking & Redemption
Referrals will be tracked using internal systems, including Referral Rock, HubSpot, and Google Forms (failure to accurately track shall not be a basis for liability):
- Participants may check their status via a secure microsite or approved reporting tool.
5. Lakehouse Award Redemption
- Must be redeemed within 12 months of earning the award.
- Reservations booked through the designated calendar system or through TMAPC.
- Blackout dates: all national holidays and Master’s Tournament weekend and any dates TMAPC deem not available.
- Availability totally at the discretion of TMAPC.
- Guests are limited to immediate family; subject to written permission after requests to TMAPC.
6. General Conditions
- Reward points are non-transferable and have no cash value unless otherwise specified.
- TMAPC is not responsible for technical issues, lost submissions, or unauthorized referrals.
- Program participants must comply with all applicable laws and professional ethics standards.
- Abuse of the program (e.g., self-referrals, fraud, misrepresentation) may result in disqualification and loss of any existing Reward Points.
7. Program Changes & Termination
- Modify or terminate the Program at any time without notice. No existing points will be eligible for any future rewards nor any monetary compensation whatsoever.
- Update terms and incentive structures as needed.
- Deny rewards in cases of suspected abuse or policy violations.
8. Past Client Referrals
Past client referrals will be reviewed on a case-by-case basis, but will not be eligible if outside the current calendar year. Contact the program coordinator if unsure whether a referral qualifies.

10. Liability & Legal Provisions
- Liability Disclaimer: TMAPC shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to this Program, including but not limited to technical errors, administrative mistakes, physical injury or disputes between referral partners and referred clients. This limitation applies to all possible causes of action, even if only tangentially associated with the Program.
- Indemnification: Participants agree to indemnify, defend, and hold harmless TMAPC, its attorneys, staff, and affiliates from any claim, loss, or expense connected to participation in this Program.
- Governing Law: These Terms & Conditions are governed by and construed under the laws of the State of Georgia.
- Dispute Resolution: All disputes shall be resolved exclusively by arbitration or mediation, at the sole election of TMAPC. Participants expressly waive any right to a jury trial.
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
